In the provisional Regulation, the facts established for Hanny Magnetics (Zuhai) Ltd during the Commission's investigation demonstrated that this company is free of government intrusion in the execution of its business operations, and individual treatment was granted.

(10) Osservazioni sono pervenute anche dall'Hong Kong Economic and Trade Office (un'autorità nazionale in materia di esportazione) e dalla Memtek Europe Ltd, che fa parte di un gruppo di società, l'Hanny Group, con sede ad Hong Kong e stabilimenti di produzione nella Repubblica popolare cinese (in seguito denominata "Hanny").

(10) Submissions were also received from the Hong Kong Economic and Trade Office (an exporting country authority) and Memtek Europe Ltd which is part of the Hanny Group of companies, a company based in Hong Kong with production in the People's Republic of China, (hereinafter referred to as "Hanny").

(17) Altre osservazioni sono giunte dall'Hong Kong Economic and Trade Office e dalla Hanny, che, pur producendo microfloppy da 3,5 pollici, non produce microfloppy da 3,5 pollici ad alta capacità. In entrambe le comunicazioni si affermava che i microfloppy da 3,5 pollici ad alta capacità non costituiscono un prodotto simile ai tradizionali microfloppy da 3,5 pollici e dovrebbero pertanto essere esclusi dal campo di applicazione delle misure.

(17) Submissions were received from the Hong Kong Economic and Trade Office and from Hanny, which, although a producer of 3,5" microdisks, is not a producer of higher-capacity 3,5" microdisks. Both submissions argued that the higher-capacity 3,5" microdisks are not a like product with conventional 3,5" microdisks, and should therefore be excluded.

In base al principio delle legittime aspettative e della certezza giuridica, la Commissione ritiene opportuno mantenere tale trattamento per questa società. Del resto, il rischio di elusioni è minimo data la lieve differenza riscontrata tra il margine di dumping per questo produttore e quello applicabile agli altri.

In the provisional Regulation, the facts established for Hanny Magnetics (Zuhai) Ltd during the Commission's investigation demonstrated that this company is free of government intrusion in the execution of its business operations, and individual treatment was granted. In the light of the principle of legitimate expectations and legal certainty, the Commission considers that the individual treatment granted to this company should be maintained. Furthermore, given the small difference found in the dumping margin for this producer and that applicable to the other producers, the risk of circumvention is minimal.
