Inspections by the competent authorities in 2004 confirmed the compliance of the irradiation facility IBA Mediris S.A. with the requirements of Directive 1999/2/EC.

a) prima del 28 dicembre 1998, data di designazione della Zona di protezione speciale (ZPS) "Valloni e steppe pedegarganiche", è venuta meno agli obblighi derivanti dall'art. 4, paragrafo 4, della direttiva 79/409/CEE [1] del Consiglio, del 2 aprile 1979, concernente la conservazione degli uccelli selvatici, nella misura in cui ha omesso di adottare misure idonee a prevenire l'inquinamento o il deterioramento degli habitat, nonché le perturbazioni dannose agli uccelli che abbiano conseguenze significative, in riferimento al piano denominato "patto d'area" ed ai progetti ivi previsti, i quali erano suscettibili di avere un impatto sugli habitat e sulle specie all'interno della IBA n. 94 (del catalogo IBA 89) "Promontorio del Gargano" ed hanno effettivamente causato il deterioramento degli habitat, nonché le perturbazioni dannose agli uccelli presenti all'interno delle suddette IBA;

(a) prior to 28 December 1998, the date for the designation of the Special Protection Area (SPA) "Valloni e steppe pedegarganiche", the Italian Republic failed to meet its obligations under Article 4(4) of Council Directive 79/409/EEC [1] of 2 April 1979 on the conservation of wild birds in so far as it failed to take appropriate steps to avoid pollution or deterioration of habitats or any disturbances affecting birds likely to have significant consequences, with reference to the plan designated "the regional agreement" and the projects outlined therein, which were liable to have an impact on the habitats and species within IBA (Important Bird Area) No 94 (from IBA Catalogue 89) "Gargano Promontory" and which have in fact brought about a deterioration of habitats and resulted in serious disturbances affecting birds within the above IBA[s];
