Komisija 2006. gada 15. septembrī saņēma paziņojumu par ierosinātu koncentrāciju saskaņā ar Padomes Regulas (EK) Nr. 139/2004 [1] 4. pantu, un pēc lietas nodošanas izskatīšanai saskaņā ar 4. panta 5. punktu Hewlett Packard Company ("HP", ASV) minētās Padomes regulas 3. panta 1. punkta b) apakšpunkta nozīmē iegūst pilnu kontroli pār uzņēmumu Mercury Interactive Corporation ("Mercury", ASV), iegādājoties tā akcijas.

1. On 15 September 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 [1] by which the undertaking Hewlett Packard Company ("HP", USA) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Mercury Interactive Corporation ("Mercury", USA) by way of purchase of shares.

211 -Apspriešanās metodes, galvenās mērķnozares un vispārīgs respondentu raksturojums Apspriešanās ar dalībvalstīm ir notikusi Valsts iepirkuma padomdevēju komitejā. Ar tiešsaistes aptaujas lapu starpniecību (Interactive Policy Making) tika organizēta publiska un uzņēmējiem un to pārstāvjiem (profesionālās asociācijas un advokāti) atvērta apspriešanās, kuras rezultātā saņemti 138 ieguldījumi. Turklāt 5 Eiropas un dalībvalstu profesionālās asociācijas ir sniegušas spontānu rakstisku ieguldījumu. Apspriešanās ar uzņēmējiem notika arī ar aptaujas lapas starpniecību, kas tika jo īpaši adresēta Eiropas uzņēmēju reprezentatīvai grupai (European Business Test Panel), kura sniedza 543 ieguldījumus. Padomdevēju komitejā notika apspriešanās arī ar neatkarīgajiem ekspertiem, tostarp uzņēmēju pārstāvjiem par valsts iepirkumu lielāku atklātību. Apspriešanās ir notikusi arī ar līgumslēdzējām iestādēm, izmantojot tiešsaistes aptaujas lapu; šīs apspriešanās rezultātā saņemti 16 ieguldījumi. -

Consultation methods used, main sectors targeted and general profile of respondents The Member States were consulted in the Advisory Committee on Public Procurement. A public consultation, open to economic operators and their representatives (professional associations and lawyers) was organised using on-line questionnaires (Interactive Policy Making), which provided 138 contributions. In addition, five European and national professional associations voluntarily offered written contributions. Economic operators were also consulted by means of a questionnaire specifically addressed to a representative panel of European enterprises (European Business Test Panel), which provided 543 contributions. Non-governmental experts, including representatives of economic operators as well, were consulted in the Advisory Committee on the Opening-up of Public Procurement. Awarding authorities were consulted by means of an on-line questionnaire, which resulted in 16 contributions. -
