(27) Europos Teisingumo Teismas savo Adria-Wien nutarime priėmė sprendimą dėl Austrijoje taikomos priemonės, vertindamas ją kaip visumą. Jeigu Teismo ketinimai būtų buvę kitokie, jis būtų pirmiausia paklausęs, ar mokesčio už elektros energiją grąžinimas yra per se selektyvi priemonė, o tik tada būtų ėmęsis spręsti, ar priemonė tapo selektyvi dėl to, kad iš jos taikymo srities buvo panaikintas paslaugų sektorius. Be to, nutarimo 36 punkte yra aiškiai nurodoma, kad Austrijos priemonė, su kuria Europos Teismas buvo išsamiai susipažinęs, nėra valstybės pagalba.

(27) The European Court of Justice decided in its Adria-Wien ruling on the Austrian measure in its entirety. If this had not been the intention, the Court would have first asked whether the energy tax rebate was per se selective and only then would it have dealt with the question whether the exclusion of the service sector made the measure selective. In addition, paragraph 36 of the ruling makes clear that the Austrian measure, with which the European Court was fully acquainted, does not constitute State aid.

(24) Netgi jeigu priemonė yra laikoma valstybės pagalba, Komisija privalo gerbti teisėtus susijusių įmonių lūkesčius. Tos įmonės galėjo remti įstatymu, kuris Austrijoje akivaizdžiai priimtas tam, kad būtų įgyvendintas Adria-Wien nutarimas. Negalima tikėtis, kad įmonė Europos teisės klausimus nagrinėtų nuodugniau nei bona fide įstatymų leidėjas. Be to, Teisingumo Teismas kaip institucija, atsakydama į antrąjį Austrijos Konstitucinio Teismo klausimą sužadino teisėtus lūkesčius.

(24) Even if a measure is classified as State aid, the Commission has to respect the legitimate expectations of the undertakings concerned. These undertakings could rely on a law which was explicitly adopted in Austria in order to implement the Adria-Wien ruling. It cannot be asked of an undertaking that it examine questions of European law in greater depth than a bona fide legislator. Furthermore, the Court of Justice itself, as an EU institution, raised legitimate expectations by answering the second question referred by the Austrian Constitutional Court.

(16) Austrijos pramonės asociacijos nuomone, priemonė nėra taikoma pasirinktinai, dėl to ji negali būti laikoma valstybės pagalba. Austrija įgyvendino Europos Teisingumo Teismo Adria-Wien nutarimą, kad nacionalinės priemonės, pagal kurias numatoma grąžinti mokestį už elektros energiją ir gamtines dujas, nėra valstybės pagalba "jeigu jos valstybės teritorijoje yra taikomos visoms įmonėms, kad ir kokia būtų jų veikla". Savo antrajame klausime Teisingumo Teismui Austrijos Konstitucinis Teismas teigė, kad Austrija galėtų tokias mokesčio grąžinimo priemones pradėti taikyti visoms bendrovėms. Teisingumo Teismas, kuris labai gerai žinojo mokesčio grąžinimo paskirtį, žinoma, įvertino tokios priemonės galimą teisinį poveikį Austrijai. Todėl vienintelis reikšmingas klausimas šiuo atveju yra "ar diferencijuojama pagal privalumus".

(16) The Austrian Industry Association considers the measure not to be selective and therefore not to be State aid. Austria has implemented the Adria-Wien ruling of the European Court of Justice, whereby national measures which provide for a rebate of energy taxes on natural gas and electricity do not constitute State aid "where they apply to all undertakings in national territory, regardless of their activity". The Austrian Constitutional Court had reasoned in its second question to the Court of Justice that Austria might be in a position to extend the energy tax rebates to all companies. Thus, the Court of Justice was well aware of the function of the rebate and certainly considered potential legal effects in Austria. The only material question is therefore "whether a distinction is made with regard to the advantage".

(toliau — AMC, Kroatija), Sanoma Magazines Zagreb d.o.o. (toliau — Sanoma Zagreb, Kroatija) ir Sanoma Magazines SMG d.o.o. On 22 December 2005, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 [1] by which the undertakings G+J International Publishing Holding GmbH ("G+J", Austria) belonging to the Bertelsmann Group and Sanoma Magazines International B.V. ("SMI", Netherlands) belonging to the Sanoma WSOY group acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertakings Burda d.o.o. ("Burda Slovenia", Slovenia), Burda National d.o.o. ("Burda Croatia", Croatia), Izdavacka Kuca Burda d.o.o. ("Burda SMG", Serbia-Montenegro), Adria Magazin d.o.o. ("AMC", Croatia), Sanoma Magazines Zagreb d.o.o. ("Sanoma Zagreb", Croatia) and Sanoma Magazines SMG d.o.o. ("Sanoma SMG", Serbia-Montenegro), by way of purchase of shares in a newly created company constituting a joint venture ("JV", Austria).

(66) Viena vertus, vertindama šią bylą, Komisija pažymi, kad nagrinėjamos nacionalinės priemonės aplinkosaugos interesų labui Austrijos įmonėms sukūrė nemažą naštą. Jeigu nebūtų taikomas šiame sprendime nagrinėjamas mokesčių grąžinimas, tokia našta daug elektros energijos naudojančioms įmonėms būtų itin sunki. Kai ši nacionalinė priemonė buvo kuriama, nebuvo jokios nusistovėjusios praktikos, kaip teisiškai turėtų būti vertinamas atleidimas nuo tokių mokesčių arba jų sumažinimas, kai tokios priemonės oficialiai yra taikomos visuose ekonomikos sektoriuose, tačiau vis dėlto yra selektyvios, nes kai kuriems sektoriams suteikia faktinio, de facto ir specifinio pranašumo. Kita vertus, visiškai įmanoma, kad šioje byloje Teismo atsakymo į antrąjį klausimą Adria-Wien byloje formuluotė galėjo kai kuriuos naudos gavėjus priversti nuoširdžiai patikėti, kad Teismo nagrinėjamos nacionalinės priemonės nustotų būti selektyvios ir dėl to nebebūtų laikomos valstybės pagalba, jeigu jų taikymo sritis būtų išplėsta, įtraukiant ir kitus, ne tik prekių gamybos, sektorius. Atsižvelgdama į visas šias aplinkybes, Komisija daro išvadą, kad šioje byloje pagalbos išieškojimas prieštarautų teisėtų lūkesčių apsaugos principui. Todėl, vadovaudamasi Reglamento Nr. 659/99 14 straipsniu, Komisija nusprendžia, kad pagalbos išieškoti nebus reikalaujama.

(66) In the present case, on the one hand, the Commission notes that the national measures at issue imposed a significant burden on Austrian undertakings in the interests of environmental protection. Such a burden would have been particularly heavy for energy-intensive undertakings without the tax rebate assessed in this Decision. When the national measure was drawn up, there was no established practice regarding the legal assessment of exemptions from or reductions in such taxes which formally apply to different sectors of the economy but which are nevertheless selective, because they grant an intrinsic, de facto and specific advantage to certain sectors. On the other hand, it is conceivable that, in the present case, the wording of the Court’s answer to the second question in Adria-Wien may have led some beneficiaries to believe in good faith that the national measures at issue before the national court would cease to be selective, and therefore cease to constitute State aid, if their benefit were extended to sectors other than the manufacture of goods. Taking all these considerations into account, the Commission comes to the conclusion that, in the present case, recovery would be contrary to the principle of protection of legitimate expectations. Therefore, in accordance with Article 14 of Regulation (EC) No 659/1999, the Commission decides that recovery shall not be required.
