(103) Nutraukus priemonių galiojimą kiltų rizika, kad Bendrijos pramonę gali susilpninti besitęsiantis/pasikartojantis importo dempingas. Iš tikrųjų, kaip pažymėta 92 konstatuojamoje dalyje, ir atsižvelgiant į išskirtinį orientuoto grūdėtumo elektrotechninių lakštų gamybos pobūdį ir kompleksiškumą, dabartiniai orientuoto grūdėtumo elektrotechninių lakštų pasaulinio tiekimo šaltiniai yra negausūs. Jei Bendrijos pramonė sumažintų savo veiklos apimtis, orientuoto grūdėtumo elektrotechninių lakštų vartotojai taptų vis labiau priklausomi nuo importuojamų medžiagų.

(103) If measures were to be repealed the situation of the Community industry risks to be weakened further by a continuation/recurrence of dumped imports. Indeed, as noted at recital 92 above and taking account the specific nature and the complexity of GOES manufacturing, the number of available sources of supply of GOES is rather limited at world level. Should the Community industry decrease its activity, this would make users of GOES progressively more dependent on imported materials.

(101) Be to, taip pat buvo kritikuojamas tas faktas, kad Thyssen Krupp grupė buvo ir vienintelis silikoninio-elektrotechninio plieno gamintojas Bendrijoje, ir trijų iš keturių Bendrijos orientuoto grūdėtumo elektrotechninių lakštų gamintojų savininkė.

(101) In addition, the fact that the Thyssen Krupp group was both the sole producer of silicon electrical steel in the Community and owner of three of the four Community producers of GOES was also criticised.

(108) Pagal pirmiau minėtus faktus galima daryti išvadą, kad, kaip numatyta Pagrindinio reglamento 11 straipsnio 2 dalyje, orientuoto grūdėtumo elektrotechninių lakštų, kurių kilmės šalis – Rusija, importui taikomos antidempingo priemonės, nustatytos Sprendimu Nr. 303/96/EAPB, turėtų būti išlaikytos,

(108) It follows from the above that, as provided for by Article 11(2) of the basic Regulation, the anti-dumping measures applicable to imports of GOES originating in Russia, imposed by Decision No 303/96/ECSC, should be maintained,

(75) The above table shows that the imports of GOES from the countries concerned into the Community more than tripled during the period under examination.

(79) Vienas Rusijos eksportuojantis gamintojas tvirtino, kad vertinant kainų sumažinimą (ir žalos pašalinimo dydį), koregavimus reikėtų atlikti atsižvelgiant į eksportuojančio gamintojo pagamintų ir parduotų orientuoto grūdėtumo elektrotechninių plieno lakštų ir Bendrijos pramonės pagamintų orientuoto grūdėtumo elektrotechninių plieno lakštų kokybės skirtumus. Tai patvirtinama tuo, kad tos pačios rūšies eksportuojančio gamintojo pagamintų orientuoto grūdėtumo elektrotechninių plieno lakštų kokybė būtų gerokai blogesnė nei Bendrijos pramonės pagamintų orientuoto grūdėtumo elektrotechninių plieno lakštų kokybė.

(79) One Russian exporting producer claimed that when assessing price undercutting (and injury elimination margin), adjustments should be made with respect to quality differences between GOES produced and sold by this exporting producer and those produced by the Community industry. This claim is based on the fact that, for the same types, the quality of GOES produced by this exporting producer would be considerably lower than the quality of GOES produced by the Community industry.

(99) šiuo atžvilgiu kai kurie orientuoto grūdėtumo elektrotechninių lakštų vartotojai tvirtino tyrimo metu susidūrę su pasiūlos trūkumu iš kai kurių Bendrijos gamintojų dėl tariamo esamų pajėgumų trūkumo. Kiti teigė, kad nebuvo galima importuoti orientuoto grūdėtumo elektrotechninių lakštų iš kitų šaltinių. Tačiau jie nepateikė jokių jų teiginius įrodančių patvirtinimų. Bet kuriuo atveju, tai aiškiai prieštarauja dabartinio tyrimo išvadoms. Iš tikrųjų, kaip nurodyta 64 konstatuojamoje dalyje, analizuojamu laikotarpiu Bendrijos pramonės pajėgumai buvo pakankami ir tai leido jai gaminti didesnius orientuoto grūdėtumo elektrotechninių lakštų kiekius. Be to, taip pat buvo galima importuoti orientuoto grūdėtumo elektrotechninius lakštus iš kitų šaltinių, pavyzdžiui, Lenkijos ir Čekijos Respublikos (žr. 58 konstatuojamąją dalį). Todėl šie tvirtinimai yra nepagrįsti.

(99) In this respect, certain users of GOES alleged that they had been confronted in the IP by a shortage of supply from the part of certain Community producers due to a perceived lack of available capacity. Others argued that it was not possible to import GOES from other sources. However, they did not submit any evidence supporting these allegations. In any event, this is in clear contradiction with the findings of the current investigation. Indeed, as set out at recital 64, the Community industry had available capacities in the analysis period, allowing it to produce higher quantities of GOES. In addition, it was also possible to import GOES from other sources such as Poland and the Czech Republic (see recital 58). These allegations are therefore unfounded.

Nine responses were received by the Commission, covering less than 20% of the total consumption of GOES in the Community.

(83) Nuo 1994 metų Rusijos orientuoto grūdėtumo elektrotechninių lakštų gamintojai plėtė savo pardavimų tinklą Europos bendrijoje. Pavyzdžiui, vienas iš eksportuojančių gamintojų šiuo metu turi nuosavą pardavimų struktūrą Bendrijoje. Atsižvelgiant į šiam tikslui skirtas investicijas, tampa aišku, kad Rusijos gamintojai ketina plėsti savo pardavimus ES rinkoje.

(83) Since 1994, the Russian GOES producers have developed their selling organisation in the European Community. For instance, one of the exporting producers has now its own related selling organisation in the Community. Taking account of the investments made for that purpose, it is therefore clear that Russian producers intend to develop their sales on the EU market.

(91) Galima daryti išvadą, kad, atsižvelgiant į dabartinį Bendrijos pramonės pažeidžiamumą ir jos dideles pastangas išlikti konkurencinga Europoje ir pasaulyje, laikoma, kad nustojus galioti priemonėms Bendrijos pramonei toliau keltų grėsmę numatomas didėjantis orientuoto grūdėtumo elektrotechninių lakštų importas iš Rusijos.

(91) In conclusion, taking into account the current viability of the Community industry and its strong efforts to remain competitive both at European and world level it is considered that if measures lapse the Community industry's situation would be jeopardised by a subsequent expected increase in imports of GOES from Russia.

4. Orientuoto grūdėtumo elektrotechninių lakštų importuotojų interesai

4. Interest of importers of GOES

(95) Apie 40 orientuoto grūdėtumo elektrotechninių lakštų vartotojų gavo pagal jų veiklą suderintą klausimyną.

(95) Around 40 users of GOES received a questionnaire tailored to their activity.

(118) Tam tikros suinteresuotosios šalys tvirtino, kad vieno Bendrijos pramonės gamintojo veiklos nutraukimas parodo, jog nereikia taikyti priemonių, nes tai sukeltų didelį gamybos pajėgumų sumažėjimą Bendrijoje ir taip atsirastų orientuoto grūdėtumo elektrotechninių plieno lakštų trūkumas Bendrijos rinkoje.

(118) Certain interested parties claimed that the closure of one of the producers that is part of the Community industry calls for the non imposition of measures since it would result in a significant decrease of the production capacity in the Community, thus possibly generating a shortage of GOES on the Community market.

(122) Nepaisant taikomų antidempingo priemonių didelių Rusijos kilmės orientuoto grūdėtumo elektrotechninių plieno lakštų importui, Bendrijos pramonės ekonominė padėtis žymiai pablogėjo tarp 2000 m. ir TL. Didelių Rusijos kilmės orientuoto grūdėtumo elektrotechninių plieno lakštų importui taikomų priemonių teigiamas poveikis iš tiesų susilpnėjo pradėjus dempingo kaina importuoti visų pločių orientuoto grūdėtumo elektrotechninius plieno lakštus iš Rusijos ir JAV. Šis importas nebuvo toks svarbus nagrinėjamojo laikotarpio pradžioje. Be to, daroma nuoroda į 17 konstatuojamąją dalį, kurioje aiškinama, kad galiojančių antidempingo priemonių, taikomų dideliems orientuoto grūdėtumo elektrotechninių plieno lakštams iš Rusijos, buvo vengiama pjaustant orientuoto grūdėtumo elektrotechninius plieno ritinius į dvi dalis, ne didesnes kaip 500 mm.

(122) In spite of the existing anti-dumping measures concerning imports of large GOES from Russia, the economic situation of the Community industry significantly deteriorated between 2000 and the IP. The positive impact of the measures imposed on large GOES from Russia has indeed been diluted by the emergence of the dumped imports of all widths of GOES from Russia and the USA. Those imports were significantly less important at the beginning of the period under examination. In addition, reference is also made to the recital (17), where it is explained that the anti-dumping measures in force against large GOES from Russia were avoided by cutting the coils of grain-oriented electrical steel in two halves not exceeding 500 mm.

(161) Primenama, kad 1999 m. trys Bendrijos gamintojai susijungė ir dabar priklauso vienai holdingo bendrovei (ThyssenKrupp) , siekdami veiksmingiau konkuruoti su kitais orientuoto grūdėtumo elektrotechninių plieno lakštų gamintojais pasaulio rinkoje. Tuo metu Europos Komisija ištyrė šį susijungimą ir jam pritarė.

(161) It is recalled that in 1999, three Community producers merged their activities under the same holding company (ThyssenKrupp) in order to create a larger entity which could compete more effectively with the other GOES producers on the world market. At that time, this merger was analysed in detail by the European Commission, and was approved.

(78) Komisija ištyrė, ar eksportuojantys gamintojai tyrimo laikotarpiu susijusiose šalyse sumažino Bendrijos pramonės kainas. Per šį tyrimą eksportuojančių gamintojų CIF kainos buvo patikslintos pagal Bendrijos sienos, sumokėjus importo muitą, lygį. Šios kainos buvo palygintos su Bendrijos pramonės ex-works kainomis tuo pačiu prekybos lygiu ir lyginamų prekių rūšių lygiu.(79) Vienas Rusijos eksportuojantis gamintojas tvirtino, kad vertinant kainų sumažinimą (ir žalos pašalinimo dydį), koregavimus reikėtų atlikti atsižvelgiant į eksportuojančio gamintojo pagamintų ir parduotų orientuoto grūdėtumo elektrotechninių plieno lakštų ir Bendrijos pramonės pagamintų orientuoto grūdėtumo elektrotechninių plieno lakštų kokybės skirtumus. (78) The Commission has examined whether the exporting producers in the countries concerned undercut the prices of the Community industry during the IP. For the purposes of this analysis, the CIF prices of the exporting producers have been adjusted to a Community frontier, duty paid, level. These prices have then been compared to the Community industry’s ex-works prices at the same level of trade, and at the level of comparable product types.(79) One Russian exporting producer claimed that when assessing price undercutting (and injury elimination margin), adjustments should be made with respect to quality differences between GOES produced and sold by this exporting producer and those produced by the Community industry.
