12. Lieky určené na použitie pri pokrokových liečebných postupoch by sa mali právne upraviť, pokiaľ sa plánuje ich umiestnenie na trh v členských štátoch a bez ohľadu na to, či sú pripravené priemyselne alebo vyrobené metódou, ktorej súčasťou je priemyselný proces, v zmysle článku 2 ods. 1 smernice 2001/83/ES. Lieky určené na použitie pri pokrokových liečebných postupoch, ktoré sa kompletne pripravia v nemocnici a aj sav nej použijú v súlade s lekárskym predpisom pre jednotlivého pacienta, by sa mali vyňať z rozsahu pôsobnosti tohto nariadenia.

12. Advanced therapy medicinal products should be regulated in so far as they are intended to be placed on the market in Member States and either prepared industrially or manufactured by a method involving an industrial process, within the meaning of Article 2(1) of Directive 2001/83/EC. Advanced therapy medicinal products which are both prepared in full and used in a hospital, in accordance with a medical prescription for an individual patient, should thus be excluded from the scope of the present Regulation.
