(1) Se han evaluado los riesgos del tolueno y el triclorobenceno (TCB) para las personas y el medio ambiente con arreglo al Reglamento (CEE) no 793/93 del Consejo, de 23 de marzo de 1993, sobre evaluación y control del riesgo de las sustancias existentes [3]. La evaluación del riesgo ha puesto de manifiesto la necesidad de limitar estos riesgos, y el Comité científico de la toxicidad, la ecotoxicidad y el medio ambiente ha confirmado dicha conclusión.

(1) The risks presented to man and the environment by toluene and trichlorobenzene (TCB) have been assessed under Council Regulation (EEC) No 793/93 of 23 March 1993 on the evaluation and control of the risks of existing substances [3]. The risk evaluation identified a need to limit those risks, and the Scientific Committee on Toxicity, Ecotoxicity and the Environment (CSTEE) confirmed that conclusion.

6.1 El CESE considera, como se ha indicado supra, que la Propuesta de Directiva debe basarse en el RAR y en el informe pertinente del CSTEE de manera que ha de referirse únicamente al 1,2,4-TCB. Ello debe explicitarse en el título y en el texto. Afortunadamente, el efecto de las limitaciones en cuanto al uso serán las mismas, habida cuenta de que dicho isómero es el componente principal de la mezcla de isómeros TCB que anteriormente se comercializaba para fabricar solventes o sprays.

6.1 The EESC notes, as above, that this proposal has to be based on the relevant RAR and CSTEE Opinion and therefore has to refer solely to 1,2,4-TCB. This should be made clear in the title and text. Happily the effect of the restrictions on usage will remain the same, as this isomer is the principal constituent of mixed-isomer TCBs previously sold for use in solvents or sprays.

(2) La Recomendación 2004/394/CE de la Comisión, de 29 de abril de 2004, relativa a los resultados de la evaluación del riesgo y a la estrategia de limitación del riesgo respecto a las sustancias: acetonitrilo, acrilamida, acrilonitrilo, ácido acrílico, butadieno, floruro de hidrógeno, peróxido de hidrógeno, ácido metacrílico, metacrilato de metilo, tolueno y triclorobenceno [4], adoptada en el marco del Reglamento (CEE) no 793/93, contiene una estrategia para limitar los riesgos del tolueno y el triclorobenceno (TCB), en la que se recomienda aplicar restricciones para limitar los riesgos derivados de determinados usos de dichas sustancias.

(2) Commission Recommendation 2004/394/EC of 29 April 2004 on the results of the risk evaluation and the risk reduction strategies for the substances: acetonitrile; acrylamide; acrylonitrile; acrylic acid; butadiene; hydrogen fluoride; hydrogen peroxide; methacrylic acid; methyl methacrylate; toluene; trichlorobenzene [4], adopted within the framework of Regulation (EEC) No 793/93, contains a strategy for limiting risks of toluene and TCB, recommending restrictions to limit the risks from certain uses of these substances.

5.6 Actualmente se considera que sólo queda un productor en la zona UE/OSPAR. Al parecer, los isómeros 1,2,4-TCB y 1,2,3-TCB sólo se pueden vender para su uso como productos intermedios, a lo que debe comprometerse cada comprador mediante una declaración previa por escrito.

5.6 At present there is believed to be only one remaining producer in the EU/OSPAR region. Sales are said to be restricted to the isomers 1,2,4-TCB and 1,2,3-TCB for use only as intermediates, with this being confirmed in pre-delivery written use statements from each customer.

5.5 En la UE (y en otros países), se emplea sobre todo el 1,2,4-triclorobenceno (1,2,4-TCB), con distintos grados de pureza. Al parecer, desde los años ochenta la cantidad producida disminuye paulatinamente. Los datos facilitados por la OSPAR (Comisión para la protección del entorno marino) estiman que en 1994 se produjeron entre 7 y 10 mil toneladas de 1,2,4-TCB; de 1,2,3-TCB se produjeron menos de dos mil toneladas y de 1,3,5-TCB se produjeron menos de 200 toneladas [9]. En junio de 2000, la OSPAR añadió expresamente los tres isómeros a su lista de sustancias peligrosas que requieren actuaciones prioritarias. En su informe de julio de 2001, el CSTEE indica que en 1994-95 se produjeron en Europa 7000 toneladas. El nivel de producción ha seguido disminuyendo y se estima que actualmente se sitúa en la mitad de las referidas cantidades, destinándose la mayor parte a la exportación [10].

5.5 In the EU (and elsewhere) the prime usage is of 1,2,4-Trichlorobenzene (1,2,4-TCB), in varying degrees of purity. Production is believed to have declined steadily since the 1980s. Data presented to the OSPAR Commission for the protection of the marine environment estimated 1994 production of 1,2,4-TCB as being between 7-10 thousand tonnes; 1,2,3-TCB as less than 2 thousand tonnes; and 1,3,5-TCB as less than 200 tonnes [10]. In June 2000 OSPAR added all three isomers as individual entries to its list of Hazardous Substances for Priority Action. The CSTEE Opinion of July 2001 also quotes 7 thousand tonnes production in Europe in 1994/95. Production levels have continued to decline and are currently believed to be around half these levels, with the greater part being for export [11].
