Fartyg vilkas i enlighet med konventionerna utfärdade obligatoriska certifikat med avseende på fartygskonstruktion och utrustning eller klassificeringscertifikat har utfärdats av en organisation som inte är godkänd enligt bestämmelserna i rådets direktiv 94/57/EEG av den 22 november 1994(2) om enhetliga regler och normer för fartygsinspektions- och besiktningsorganisationer och sjöfartsmyndigheters verksamhet.

5.11 Den mänskliga faktorn är en väsentlig beståndsdel och EESK välkomnar avsikten att intensifiera sektorsdialogen, med deltagande av kommissionen, arbetsgivare och fackföreningar. Man kan notera att det var inom sektorn för fartygskonstruktion som den första formella branschspecifika dialogkommittén inrättades inom metallområdet, vilket är ytterligare en indikation på sektorns innovativa attityd.

5.11 The human factor is an essential element and the EESC welcomes the intention to intensify the sectoral dialogue in which the Commission, employers and the trade unions each have their role to play. It is remarkable that it is in shipbuilding where the first formal Social Sectoral Dialogue Committee in any of the metal trades has been established; another indication for the innovative attitude of the sector.

(115) Såsom visats har Alstom sin huvudsakliga verksamhet inom områdena energi, transport och fartygskonstruktion. De ifrågavarande produkterna och tjänsterna är föremål för handel och konkurrens mellan medlemsstater. Analysen i punkt 1 visar tydligt att allt stöd till Alstom påverkar handeln mellan medlemsstaterna och snedvrider konkurrensen på den gemensamma marknaden.

(115) As stated above, Alstom’s main business areas are power generation, transport and shipbuilding. The relevant products and services are the subject of trade and competition between Member States. The points set out in point 1 demonstrate amply that any aid to Alstom affects trade between Member States and distorts competition in the common market.

(104) Alstom är en teknikkoncern som utvecklar, tillverkar och underhåller produkter och system inom tre huvudsektorer: energiproduktion, järnvägstransport och fartygskonstruktion [20]. (104) Alstom is an engineering group which designs, manufactures and provides maintenance for products and systems in three main sectors: power generation, rail transport and shipbuilding [20]. 5.12 Den sociala dialogen ger redan värdefulla bidrag inom ett brett spektrum av sociala frågor, däribland utbildning, rekrytering, livslångt lärande och anpassning till konjunkturcykler. Hittills har två arbetsgrupper inrättats, den ena med syfte att förbättra branschens image och den andra i syfte att fastställa vilka nya färdigheter som krävs inom sektorn för fartygskonstruktion.

5.12 The Social Dialogue is already making valuable contributions to a broad range of social topics, including training, recruitment, life-long learning and adjustment to cyclical waves. To date two working groups have been established, one aiming to improve the image of the industry and the other to identify new skills required within the shipbuilding sector.

1.21 Kommittén understryker innovationskraften i en mångsidig havsteknik som kan tillämpas inom flera områden. Detta gäller exempelvis sjötransporterna inklusive fartygskonstruktion, hamnverksamhet och varv, utrustning för havsbaserad utvinning, hydrografi, marin vattenbruk och miljö. Miljötekniken innebär också stora ekonomiska möjligheter. Havstekniken med sin stora innovationspotential utgör därmed både en viktig ekonomisk faktor och en stark drivkraft för forskning och utveckling.

1.21 stresses the innovative potential of a many-faceted marine technology with a wide range of applications, such as the whole sea transport sector including ship maintenance, port industries and shipyards, equipment for offshore activities, hydrography, mariculture and the environment. Environmental technology, too, opens up significant economic opportunities. Marine technology, with its high innovative potential, is thus both an important economic factor and a powerful engine for research and development;
