Yet this would be even more important because not only are industrial secrets being monitored, but also the private and political activities of people in the EU.

Bestämmelserna i detta direktiv skall inte begränsa de ansvariga myndigheternas skyldighet att tillämpa nationella föreskrifter och tillämplig rättspraxis om affärs-och industrihemligheter, inklusive immateriella rättigheter, och om hänsynstagande till allmänna intressen.

The provisions of this Directive shall not affect the obligation on the competent authorities to respect the limitations imposed by national regulations and administrative provisions and accepted legal practices with regard to commercial and industrial confidentiality, including intellectual property, and the safeguarding of the public interest.

5.6.6 Denna "hälsoskyddspluralism" krävs för att det skall finnas fler möjligheter att undvika nya tragedier, och den förutsätter att beslutsförfarandena utvecklas mot bättre insyn. 5.6.6 This "health pluralism", which is crucial to improving our chances of avoiding new tragedies, will require more transparent decision-making procedures. Without prejudice to medical or industrial confidentiality, the experts'findings and reasons for health decisions must be made public.

3. I syfte att fastställa om det gjorts intrång i en immateriell rättighet enligt de nationella bestämmelserna, och i enlighet med de nationella bestämmelserna om skydd av personuppgifter, affärs-och industrihemligheter samt yrkesmässig och administrativ tystnadsplikt, skall det tullkontor eller den tullenhet som behandlat ansökan på rättighetshavarens begäran och såvida uppgifterna är kända underrätta denne om namn på och adress till mottagaren, avsändaren, deklaranten eller innehavaren av varorna samt om ursprunget och härkomsten för de varor som misstänks göra intrång i en immateriell rättighet.

3. With a view to establishing whether an intellectual property right has been infringed under national law, and in accordance with national provisions on the protection of personal data, commercial and industrial secrecy and professional and administrative confidentiality, the customs office or department which processed the application shall inform the right-holder, at his request and if known, of the names and addresses of the consignee, the consignor, the declarant or the holder of the goods and the origin and provenance of goods suspected of infringing an intellectual property right.

7.6 De som blandar till ämnen, dvs. formulerarna som använder flera ämnen till en enda beredning, berörs av registreringen av ämnen som inte har köpts på inre marknaden. 7.6 Formulators (i.e. the firms that blend the individual substances) use a number of substances to make a single preparation, and are involved in the registration of substances that have not been purchased on the internal market. The studies conducted have confirmed that formulators are particularly concerned about the disclosure of data and information that could reveal manufacturing secrets; more particularly, indication of the code for each substance used in a preparation would reveal its formulation, jeopardising competitiveness. The Committee suggests that this requirement should only apply to substances that are classified as dangerous.
