4. Det anmälda kontrollorganet skall utföra EG-typkontrollen på följande sätt:a) Granskning av tillverkarens tekniska konstruktionsunderlag.

(b) the unsatisfactory application of the standards referred to in Article 5;

-tillverkarens tekniska konstruktionsunderlag i enlighet med bilaga 3.Ansökan skall åtföljas av det antal exemplar som är tillämpligt för den utrustning som skall godkännas.

(12) Consequently, the notified body should, under the full quality assurance system, effectively carry out an examination of the design dossier and of the changes to the approved design in accordance with point 4 of Annex II to Directive 93/42/EEC.

Sådant konstruktionsunderlag skall beskriva apparaten, ange de procedurer som använts för att säkerställa apparatens överensstämmelse med de skyddskrav som anges i artikel 4 och inkludera en teknisk rapport eller ett intyg som i båda fallen skall ha erhållits från ett behörigt organ.

This file shall describe the apparatus, set out the procedures used to ensure conformity of the apparatus with the protection requirements referred to in Article 4 and include a technical report or certificate, one or other obtained from a competent body.

(3) För att garantera största möjliga säkerhet för bröstimplantat skall de anmälda organen inom ramen för det fullständiga kvalitetssäkringssystemet undersöka produktens konstruktionsunderlag i enlighet med punkt 4 i bilaga 2 till direktiv 93/42/EEG. Följaktligen måste bröstimplantat omklassificeras som medicintekniska produkter i klass III.

(3) In order to ensure the highest possible level of safety for breast implants, notified bodies should, under the full quality assurance system, carry out an examination of the design dossier of the product in accordance with point 4 of Annex II to Directive 93/42/EEC. Consequently, it is necessary to proceed to the reclassification of breast implants as Class III medical devices.

Vad gäller det tekniska konstruktionsunderlag som de nationella myndigheterna behöver för sina inspektioner är det tillräckligt att tillverkarna, deras representanter eller de personer som ansvarar för att produkten släpps ut på marknaden håller konstruktionsunderlaget tillgängligt på den ena partens territorium under minst tio år räknat från den sista dagen då produkten tillverkades.

It shall be sufficient for manufacturers, their authorised representatives or the person responsible for placing products on the market to hold the technical documents required by the national authorities for inspection purposes at their disposal in the territory of one of the Parties for a period of at least ten years after the last date of manufacture of the product.

In the case of apparatus for which the manufacturer has not applied, or has applied only in part, the standards referred to in Article 7 (1) or failing such standards, the manufacturer or his authorized representative established within the Community shall hold at the disposal of the relevant competent authorities, as soon as the apparatus is placed on the market, a technical construction file.
