It seems very persuasive to listen to what is written in the Civil Code saying that “marriage is a special contract of permanent union between a man and a woman.” That way stated clearly. But, haven’t you every wondered why the Civil Code used the words “man” and “woman?” Haven’t you wondered why it didn’t use the words “male” and “female”? Why didn’t it just say “marriage is a special contract between a male and a female?” Let’s pin and leave those questions in our minds for a while before we go on further. I’d like to discuss something about Linguistics that may shatter all things we learned about SYNONYMS when we were in High School and Elementary. Prototypicality is discussed in The Grammar Book by Murcia and Freeman (pages 41 to 43). Prototypicality is a Linguistic principle stating that no two words have exactly the same meaning in a language. There maybe some which are closely similar but they are not exactly the same. They differ in meaning, intention, use, formality and many more. The only closest words in the English language are BEAUTIFUL, PRETTY and ATTRACTIVE but, still, they are not exactly the same. Now, going back to the definition of marriage and applying the principles of Prototypicality, we realize that that is the reason why they didn’t use the words “male” and “female.” The reason is that they mean differently. Consulting Online Merriam-Webster Dictionary in m-w.com, we may find that a male “is an individual that produces gametes which fertilize eggs.” The definition is very biological. It is biologically referred to. Consulting the same dictionary, we may find that a female “is an individual capable of producing eggs for reproduction.” Again, the definition is very biological. It is biologically referred to. But if we try to look “man” and “woman” up in the dictionary, we will find that they are “an individual having the characteristics of masculinity” and “an individual having the characteristics of femininity,” respectively. The definitions are broad. There was no line written between the characteristics of a man and a woman. Well, if we follow the line of reasoning of the people saying that marriage is only between a biological man and a biological woman, we are caught flat footed. Lydia de Vega, a Philippine Olympics achiever during 1984 to 1988, the fastest woman in the 1980’s, is biologically a male. She was married to Mr. Mercado, who’s a male, and therefore, had same sex marriage. Lydia de Vega is a hermaphrodite.
