(54) In its observations, the Federal Government of Germany also stressed the substantial difference between the Dutch and Italian cases. First, the de minimis rule was clearly not applicable to the measure adopted by the Region of Piedmont and any discussion on that basis would be pointless. Second, the German Government took the view that the measure fell to be assessed under the Community guidelines on State aid for environmental protection, because of its stated objective (as distinct from its effect). The other arguments put forward by the German Government did not differ from those of OMV Erdgas [19].

48. In 2003, the Competition DG had ensured that Gazprom and the Italian oil and gas company Eni Spa[31] would abandon such practices. In February[32], the Competition DG secured improvements to gas supply contracts between the Austrian incumbent gas wholesaler OMV and Russian gas producer Gazprom. In particular, OMV will no longer be prevented from reselling, outside Austria, the gas it buys from Gazprom, and Gazprom will be free to sell to other customers in Austria without having to first offer the gas to OMV (so-called right of first refusal). OMV also agreed to contribute to increasing capacity on the TAG pipeline that transports Russian gas, through Austria, to Italy. This outcome is similar to that reached with respect to Eni in 2003. The undertakings given are identical in substance to those given to the Commission by Eni, the other shareholder of the TAG pipeline, in October 2003. In light of these developments, it was decided to close the investigation.

48. En 2003, la DG Concurrence a fait en sorte que Gazprom et la société pétrolière et gazière Eni Spa[31] abandonnent ces pratiques. En février[32], elle a obtenu des améliorations aux contrats de fourniture de gaz conclus entre le grossiste historique autrichien OMV et le producteur de gaz russe Gazprom. En particulier, OMV ne sera plus empêchée de revendre en dehors de l’Autriche le gaz qu’elle achète à Gazprom, et cette dernière pourra vendre du gaz à d’autres clients autrichiens sans devoir l’offrir d’abord à OMV («droit de premier refus»). OMV a également accepté d’accroître sa capacité au niveau du gazoduc TAG qui transporte le gaz russe à travers l’Autriche vers l’Italie. Ce résultat est analogue à celui obtenu avec ENI en 2003. Les engagements donnés sont pour l’essentiel identiques à ceux pris envers la Commission par ENI, l’autre actionnaire du gazoduc TAG, en octobre 2003. Compte tenu de cette évolution, il a été décidé de clôturer l’enquête.

Speaking as an Austrian, I would like to point out that it was an Austrian company, OMV, that was, in 1968, the first to conclude a supply contract with Gasprom, which has been absolutely reliable for nearly forty years.

(53) OMV Erdgas pointed to the favourable environmental effects expected from the proposed initiative and the importance of promoting the use of natural gas as an objective of environmental policy. The use of natural gas as motor fuel had triggered a major conversion effort by the main car manufacturers in Europe (Fiat, Opel, Volvo, Renault, VW, Ford and Mercedes) and was deeply affecting the commercial vehicle sector too. Yet the market for natural gas was not mature and needed further investments. The first step in that direction was the development of an appropriate service station infrastructure which, given the limited number of natural gas-driven vehicles on the roads in Europe, was as yet not profitable. The proposal for a Directive presented by the Commission on 7 November 2001 set a target share of the motor fuel market for natural gas of 10% by 2020 [18]. Support for the establishment of the natural gas infrastructure was therefore necessary and justified. OMV Erdgas also pointed to the substantial difference between the scheme proposed by Piedmont and the Dutch scheme: in the latter case, Dutch service stations located along the border with Germany were granted aid in order to compensate for excise differentials in the border region and allow Dutch outlets to compete on an equal footing with German stations across the border. This was not the case in Piedmont.

(53) OMV Erdgas souligne les effets bénéfiques que l'initiative proposée devrait avoir sur l'environnement et l'importance de promouvoir l'usage du méthane comme objectif de politique environnementale. L'usage du méthane comme carburant a exigé un effort considérable de reconversion de la part des principaux constructeurs automobiles européens (Fiat, Opel, Volvo, Renault, VW, Ford et Mercedes) et influence profondément aussi le secteur des véhicules utilitaires. Toutefois, le marché du méthane n'a pas encore atteint un degré de maturité avancé et nécessite de nouveaux investissements. Le premier pas dans cette direction consiste dans le développement d'une infrastructure adéquate de stations-service qui, compte tenu du nombre limité de véhicules au méthane qui circulent en Europe, n'est pas encore rentable. La proposition de directive présentée par la Commission le 7 novembre 2001 a fixé comme objectif, d'ici à 2020, une utilisation du méthane comme carburant égale à 10% du marché des combustibles [18]. Par conséquent, il est nécessaire et justifié de soutenir la réalisation de l'infrastructure pour le gaz méthane. OMV Erdgas souligne en outre la différence importante entre le régime proposé par le Piémont et le projet néerlandais, qui prévoit l'octroi d'aides aux stations-service néerlandaises situées à la frontière avec l'Allemagne pour compenser le différentiel d'accises appliquées dans les régions frontalières et qui permet de cette façon aux distributeurs néerlandais de concurrencer les stations-service allemandes au-delà de la frontière dans des conditions d'égalité. Il n'en va pas de même dans le cas du Piémont.

The proposal allows for re-valuation of the supplies to the open market value (OMV). The proposed new paragraph (8) to Article 11(A) of the Sixth Directive adjusts and replaces the definition of OMV found in Article 11(A)(1)(d) to cater for this change. Of the two main options, re-valuing using the OMV or the cost price, the Commission feels that OMV is the most appropriate. The cost price would only have the effect of enabling Member States to neutralise the tax loss suffered through the low value whilst OMV allows the tax authorities the possibility to protect some of the tax on the value added. Neither the OMV nor the cost price are necessarily easily calculated on each supply but the OMV gives Member States the greatest scope to collect something approximating to the tax which would otherwise be due. To provide some additional protection for the taxpayer, the proposal re-affirms that the OMV may be below the cost of making the supply, but also establishes that the OMV should normally be, as a minimum, the cost price.

La proposition permet la réévaluation des opérations au niveau de la valeur normale. Le nouveau paragraphe 8 proposé pour l'article 11, titre A, de la sixième directive modifie et remplace la définition de la valeur normale qui figurait à l'article 11, titre A, paragraphe 1, point d), afin de tenir compte de ce changement. Face aux deux principales options qui s'offrent (réévaluer au niveau de la valeur normale ou sur la base du prix de revient), la Commission est d'avis que le recours à la valeur normale est la solution la plus adéquate. Le prix de revient aurait pour seul effet de permettre aux États membres de neutraliser la perte de recettes fiscales subie en raison d'une réduction de la base imposable, alors que la valeur normale permet aux autorités fiscales de protéger une partie de la taxe sur la valeur ajoutée. Ni la valeur normale ni le prix de revient ne sont nécessairement faciles à calculer pour chaque opération, mais la première laisse entrevoir aux États membres une possibilité plus grande de percevoir un montant se rapprochant de la taxe qui aurait normalement été due. Pour fournir une protection supplémentaire au contribuable, la proposition réaffirme que la valeur normale peut être inférieure au coût de réalisation de l'opération, mais elle établit aussi qu'elle devrait normalement être au minimum égale au prix de revient.
