The European agencies have been set up in successive waves in order to meet specific needs on a case-by-case basis. They are typified by their diversity. If these agencies are set up in an uncoordinated manner, without a common framework having been defined, this is likely to result in a situation which is rather untransparent, difficult for the public to understand, and, at all events, detrimental to legal certainty.

Eiropas aģentūru veidošana ir notikusi viļņveidīgi, lai tās katrā atsevišķajā gadījumā atbilstu konkrētām vajadzībām. Tās ir ļoti dažādas. Šo aģentūru nekoordinēta izveide bez izstrādātiem kopīgiem pamatnoteikumiem var radīt situāciju, kas ir nepārskatāma un nesaprotama iedzīvotājiem un jebkurā gadījumā arī apdraud juridisko noteiktību.

(2) Without a common framework, the proliferation of designations, tasks, structures and control arrangements for these agencies has resulted in a situation which is rather untransparent, difficult to understand and detrimental to legal certainty. Greater transparency and coherence are therefore needed in order to prevent the legislative authority from setting up agencies which are increasingly diverse, thereby undermining the unity of the executive function.

(2) Sakarā ar to, ka nepastāv kopīga sistēma, dažādi šo aģentūru nosaukumi, uzdevumi, struktūras un to kontroles mehānismi rada nepārskatāmu un grūti saprotamu situāciju, kas apdraud juridisko noteiktību. Tādēļ nepieciešama lielāka pārskatāmība un konsekvence, lai izvairītos no tā, ka likumdevējs izveido aizvien atšķirīgākas aģentūras, mazinot izpildes funkcijas vienotību.

76. Moreover, the limited financial amounts involved in even these relatively large bilateral projects make it more difficult to insist on the accompanying measures actually being taken. For example, in Tanzania, the Commission sought to ensure that the government allocated more of the revenue earned from hunting concessions to covering the operating costs of the game reserves. However, the Commission did not address the fundamental issue of the untransparent way hunting concessions were awarded, and this was made more difficult by the fact that the project concerned was only for 2 million euro. In this respect, the inclusion of environmental policy and legal reform packages in large direct budgetary support would be a better way to help establish the necessary frameworks in which project level interventions could be sustainable and have an impact.

76. Turklāt, tā kā līdzekļu summas, kas piešķirtas pat šādiem samērā lieliem divpusējiem projektiem, ir ierobežotas, ir vēl grūtāk pieprasīt, lai papildu pasākumi tiktu faktiski veikti. Piemēram, Tanzānijā Komisija mēģināja nodrošināt, lai valdība medījumu dzīvnieku rezervātu darbības izmaksām piešķirtu vairāk ieņēmumu, kas gūti no medību koncesijām. Tomēr Komisija nerisināja pamatjautājumu par nepārredzamu veidu, kādā medību koncesijas tika piešķirtas, un to bija vēl grūtāk izdarīt tādēļ, ka šim projektam bija piešķirti tikai 2 miljoni EUR. Šajā ziņā vides politikas un tiesiskā regulējuma paketes iekļaušana lielā tiešā budžeta atbalstā būtu labāks veids, kā palīdzēt izveidot vajadzīgās sistēmas, lai intervences pasākumi projektu līmenī būtu ilgtspējīgas un ietekmīgas.

(34) In their letter of 17 October 2002, UK Steel Enterprise Ltd. (hereinafter UK Steel) submitted that overcapacity, excessive third-country competition and low prices were the features of this sector and all indicated that a normal private investor would not have contributed capital towards the creation of new capacity. It should be questioned whether Hierros Añón and Rodonita themselves would have invested in this project had it not been for the availability of illegal state aid. Furthermore, the fact that Hierros Añón and Rodonita were to use 70% of the output for their own internal purposes had to put a question mark over the likely profitability of Siderúrgica Añón. Transfer pricing of the product would be untransparent and would presumably be geared more towards maximising the downstream profitability of Hierros Añón and Rodonita than that of Siderúrgica Añón.

(74) Tāpat Komisija nevar pieņemt argumentus par galvojuma īpašajām iezīmēm (sk. 47. apsvērumu) un līdz ar to cenas samazinājumu salīdzinājumā ar "normālu" tirgu šādu iemeslu dēļ: a) tas, ka Spānijā galvojumi parasti ir izpildāmi pēc pirmā pieprasījuma, ir izskaidrojams ar to, ka no saņēmēja tiek prasītas arī citas garantijas. Turpretī minētajā lietā IGAPE nepārprotami atteicās no savām tiesībām pieprasīt jebkāda cita veida garantijas (saskaņā ar Galīsijas valdības noslēgto vienošanos); b) tas, ka galvojums sedz tikai 30% no aizdevuma ir nesvarīgs, jo galvotājam pats svarīgākais faktors ir riska summa; un c) arī tas, ka projekta virzītāji ir grupas ar atzītu maksātspēju, ir nesvarīgs, ņemot vērā to, ka minētās grupas nebūtu atbildīgas par Siderúrgica Añón parādiem.(75) Šajos apstākļos Komisija šajā īpašā gadījumā uzskata, ka līdzīga galvojuma tirgus procentu modelim jābūt vismaz Spānijas atbildīgo institūciju norādītajiem 0,6% gadā (sk. 47. apsvērumu).
