(10) The aid will be provided in the form of a direct investment grant of EUR 14,204 million and in the form of an investment premium of EUR 6,716 million on the basis of the joint Federal Government/Länder scheme for improving regional economic structures (in original language: "Gemeinschaftsaufgabe Verbesserung der regionalen Wirtschaftsstruktur") [3] (hereinafter referred to as the GA scheme) and under the aid scheme entitled "Investment premium for investment at operational level in the year 2004" (in original language: "Investitionszulage für betriebliche Investitionen im Jahr 2004") [4]. Germany will ensure that the 50% ceiling for aid intensity will not be exceeded.

(10) O auxílio será concedido sob a forma de uma subvenção directa ao investimento num montante de 14204 milhões de euros e de um prémio ao investimento no montante de 6716 milhões de euros com base na tarefa de interesse comum "Melhoria da estrutura económica regional" [3] (em seguida denominada "Acção de interesse comum") e no âmbito do programa de auxílio "Prémios a favor dos investimentos industriais em 2004" [4]. A Alemanha garantirá que o montante limite do auxílio de 50% não será ultrapassado.

KG ("G+J"), and Axel Springer AG ("Springer"), would acquire joint control of the German undertaking NewCo ("NewCo") by way of purchase of shares in a newly created company constituting a joint venture. (12) Die geplante Pipeline wird nach dem Common Carrier-Prinzip des gleichen Zugangs zu unterschiedslosen Konditionen sowie dem Minimum Profit-Prinzip betrieben. Alle Ethylenproduzenten und -abnehmer werden die Pipeline zu nicht diskriminierenden Bedingungen in Anspruch nehmen können. Die Kapazität der Pipeline wird so ausgelegt, dass diese Prinzipien respektiert werden können (die verfügbare Reservekapazität beträgt ca. 50%). Diese Bedingungen müssen mindestens 25 Jahre eingehalten werden.
