(40) In accordance with the above findings that Terphane and Jolybar were found not to have circumvented the countervailing measures in force, these companies should also be exempted from the extension of the measures envisaged.

(39) By Regulation (EC) No 1830/2004 [13], the Commission amended the initiating Regulation in order to cease registration of imports of PET film from Terphane and Jolybar which were found not to be circumventing the countervailing duties.

(38) The Commission received a request for exemption from the registration and measures from Terphane and Jolybar. As stated in recitals 24 and 27, these companies cooperated in the investigation, by submitting a questionnaire reply and accepting a verification visit.

(2) By Regulations (EC) No 1975/2004[5] and No 1976/2004[6], the Council extended these measures to PET film consigned from Israel and from Brazil (‘the extended measures’) with the exception of imports produced by one Brazilian company, Terphane Ltda, and one Israeli company, Jolybar Ltd, specifically mentioned in each of those regulations.

(40) The Commission received a request for exemption from the registration and measures from Terphane and Jolybar. By Regulation (EC) No 1830/2004 [14], the Commission amended the initiating Regulation in order to cease registration of imports of PET film from Terphane and Jolybar which were found not to be circumventing the anti-dumping duties.

(40) La Comisión recibió una solicitud de exención del registro y de las medidas presentada por Terphane y Jolybar. Como se indica en los considerandos 24 y 27, estas empresas cooperaron en la investigación enviando respuestas al cuestionario y aceptando visitas de inspección. Mediante su Reglamento (CE) no 1830/2004 [14], la Comisión modificó el Reglamento de apertura con objeto de cesar el registro de las importaciones de películas de PET de las empresas Terphane y Jolybar, dado que se consideró que no estaban eludiendo los derechos antidumping.

(43) In accordance with Article 14(5) of the basic Regulation, which provides that measures shall be applied against registered imports from the date of registration, the anti-dumping duty should be collected on imports of PET film consigned from Brazil and consigned from Israel which entered the Community under registration imposed by the initiating Regulation with the exception of imports of PET film consigned from Brazil and produced by Terphane and consigned from Israel and produced by Jolybar.

(43) De conformidad con el apartado 5 del artículo 14 del Reglamento de base, que estipula que las medidas se apliquen contra las importaciones registradas a partir de la fecha del registro, el derecho antidumping se percibirá sobre las importaciones de películas de PET enviadas de Brasil e Israel que entraron en la Comunidad bajo registro impuesto por el Reglamento de apertura, con excepción de las importaciones de este producto enviadas de Brasil y fabricadas por Terphane y las enviadas de Israel y fabricadas por Jolybar.

(42) In accordance with Article 24(5) of the basic Regulation, which provides that measures shall be applied against registered imports from the date of registration, the countervailing duty should be collected on imports of PET film consigned from Brazil and consigned from Israel which entered the Community under registration imposed by the initiating Regulation with the exception of imports of PET film consigned from Brazil and produced by Terphane and those consigned from Israel and produced by Jolybar.

(42) De conformidad con el apartado 5 del artículo 24 del Reglamento de base, que estipula que las medidas se apliquen contra las importaciones registradas a partir de la fecha del registro, el derecho compensatorio se percibirá sobre las importaciones de películas de PET enviadas de Brasil e Israel que entraron en la Comunidad bajo registro impuesto por el Reglamento de apertura, con excepción de las importaciones de este producto enviadas de Brasil y fabricadas por Terphane y las enviadas de Israel y fabricadas por Jolybar.

(44) The exemptions from the extended measures granted to PET film produced by Jolybar and by Terphane shall, in accordance with Article 13(4) of the basic Regulation, remain valid under the requirement that it is not established that the exemption was granted on the basis of false or misleading information submitted by the companies concerned. Should prima facie evidence indicate otherwise, an investigation may be initiated by the Commission to establish if withdrawal of the exemption is warranted.

(44) De conformidad con el apartado 4 del artículo 13 del Reglamento de base, sigue siendo válida la exención de las medidas ampliadas concedida para las películas de PET fabricadas por Jolybar y Terphane, siempre que no se establezca que la exención se concedió sobre la base de información falsa o engañosa facilitada por las empresas afectadas. Si existieran pruebas suficientes de ello, la Comisión puede abrir una investigación a fin de establecer si está justificada la retirada de la exención.

(43) The exemptions from the extended measures granted to PET film produced by Jolybar and to Terphane shall, in accordance with Article 23(3) of the basic Regulation, remain valid under the requirement that it is not established that the exemption was granted on the basis of false or misleading information submitted by the companies concerned. Should prima facie evidence indicate otherwise, an investigation may be initiated by the Commission to establish if withdrawal of the exemption is warranted.

(43) De conformidad con el apartado 3 del artículo 23 del Reglamento de base, continúa siendo válida la exención de las medidas ampliadas concedida para las películas de PET fabricadas por Jolybar y Terphane, siempre que no se establezca que la exención se concedió sobre la base de información falsa o engañosa facilitada por las empresas afectadas. Si existieran pruebas suficientes de ello, la Comisión puede abrir una investigación a fin de establecer si está justificada la retirada de la exención.

2. The duty extended by paragraph 1 of this Article shall be collected on imports registered in accordance with Article 2 of Regulation (EC) No 284/2004 and Articles 13(3) and 14(5) of Regulation (EC) No 384/96 with the exception of those produced by Terphane Ltda, BR 101, km 101, City of Cabo de Santo Agostinho, State of Pernambuco, Brazil and by Jolybar Filmtechnic Converting Ltd. (1987), Hacharutsim str. 7, Ind. Park Siim 2000, Natania South, 42504, POB 8380, Israel.

2. Se percibirá el derecho ampliado a tenor de lo dispuesto en el apartado 1 del presente artículo sobre las importaciones registradas de conformidad con el artículo 2 del Reglamento (CE) no 284/2004, el apartado 3 del artículo 13 y el apartado 5 del artículo 14 del Reglamento (CE) no 384/96, con la excepción de las producidas por Terphane Ltda., BR 101, km 101, Ciudad de Cabo de Santo Agostinho, Estado de Pernambuco, Brasil y por Jolybar Filmtechnic Converting Ltd (1987), Hacharutsim str. 7, Ind. Park Siim 2000, Natania South, 42504, POB 8380, Israel.

2. The duty extended by paragraph 1 of this Article shall be collected on imports registered in accordance with Article 2 of Regulation (EC) No 283/2004 and Article 23(2) and Article 24(5) of Regulation (EC) No 2026/97 with the exception of those produced by Terphane Ltda, BR 101, km 101, City of Cabo de Santo Agostinho, State of Pernambuco, Brazil and by Jolybar Filmtechnic Converting Ltd (1987), Hacharutsim str. 7, Ind. Park Siim 2000, Natania South, 42504, POB 8380, Israel.

2. Se percibirá el derecho ampliado a tenor de lo dispuesto en el apartado 1 del presente artículo sobre las importaciones registradas de conformidad con el artículo 2 del Reglamento (CE) no 283/2004, el apartado 2 del artículo 23 y el apartado 5 del artículo 24 del Reglamento (CE) no 2026/97, con la excepción de las producidas por Terphane Ltda, BR 101, km 101, Ciudad de Cabo de Santo Agostinho, Estado de Pernambuco, Brasil y por Jolybar Filmtechnic Converting Ltd (1987), Hacharutsim str. 7, Ind. Park Siim 2000, Natania South, 42504, POB 8380, Israel.

(41) In view of the findings above, it is found that circumvention has taken place within the meaning of Article 23(1) of the basic Regulation. In accordance with Article 23(1) of the basic Regulation, the existing countervailing measures on imports of the product concerned (i.e. PET film originating in India) should be extended to imports of PET film consigned from Brazil or Israel, whether declared as originating in Brazil or Israel or not with the exception of those manufactured by Terphane and by Jolybar.

(41) Teniendo en cuenta las conclusiones mencionadas, se concluye que existe una elusión de las medidas a efectos de la segunda frase del apartado 1 del artículo 23 del Reglamento de base. De conformidad con la primera frase del apartado 1 del artículo 23 de dicho Reglamento, las medidas compensatorias vigentes sobre las importaciones del producto afectado (es decir, películas de PET originarias de la India) deben ampliarse a las importaciones del mismo producto procedentes de Brasil e Israel, hayan sido o no declaradas como originarias de dichos países, con las excepción de las fabricadas por Terphane y Jolybar.

(42) In view of the findings above, it is found that circumvention has taken place within the meaning of Article 13(1) of the basic Regulation. In accordance with Article 13(1) first sentence of the basic Regulation, the existing anti-dumping measures on imports of the product concerned (i.e. PET film originating in India), should be extended to imports of PET film consigned from Brazil or Israel, whether declared as originating in Brazil or in Israel or not, with the exception of those manufactured by Terphane and Jolybar.

(42) Teniendo en cuenta las conclusiones anteriormente mencionadas sobre la elusión a efectos de la segunda frase del apartado 1 del artículo 13 del Reglamento de base y de conformidad con la primera frase del apartado 1 del artículo 13 de dicho Reglamento, las medidas antidumping vigentes sobre las importaciones del producto afectado (es decir, películas de PET originarias de la India) deben ampliarse a las importaciones del mismo producto procedentes de Brasil e Israel, hayan sido o no declaradas originarias de dichos países, con las excepción de las fabricadas por Terphane y Jolybar.

(45) The non-extension of the duties to the imports of PET film from Terphane and Jolybar was established on the basis of the findings of the present investigation. This non-extension is thus exclusively applicable to imports of PET film consigned from Brazil or Israel, respectively, and produced by these specific legal entities. Imported PET film produced or consigned by any other company not specifically mentioned in the operative part of this Regulation with its name and address, including entities related to those specifically mentioned, cannot benefit from the exemption and should be subject to the residual duty rate as imposed by Regulation (EC) No 1676/2001.

(45) La decisión de no ampliar los derechos a las importaciones del producto afectado producidas por Terphane y Jolybar se estableció sobre la base de las conclusiones de la presente investigación. Así pues, esta no ampliación será aplicable exclusivamente a las importaciones del producto afectado enviadas de Brasil e Israel, respectivamente, y fabricadas por estas dos entidades jurídicas en concreto. Los productos importados fabricados o consignados por cualquier otra empresa no mencionada específicamente en la parte dispositiva del presente Reglamento con su nombre y dirección, incluidas las entidades vinculadas a las mencionadas específicamente, no podrán beneficiarse de la exención y estarán sujetos al tipo del derecho residual establecido mediante el Reglamento (CE) no 1676/2001.

(44) The non-extension of the duties to the imports of PET film from Terphane and Jolybar was established on the basis of the findings of the present investigation. This non-extension is thus exclusively applicable to imports of PET film consigned from Brazil or Israel, respectively, and produced by these specific legal entities. Imported PET film produced or consigned by any other company not specifically mentioned in the operative part of this Regulation with its name and address, including entities related to those specifically mentioned, cannot benefit from the exemption and should be subject to the residual duty rate as imposed by Regulation (EC) No 2597/1999.

(44) La decisión de no ampliar los derechos a las importaciones del producto afectado producidas por Terphane y Jolybar se estableció sobre la base de las conclusiones de la presente investigación. Así pues, la no ampliación será aplicable exclusivamente a las importaciones del producto afectado consignadas de Brasil e Israel, respectivamente, y fabricadas por estas dos entidades jurídicas en concreto. Los productos importados fabricados o enviadas por cualquier otra empresa no mencionada específicamente en la parte dispositiva del presente Reglamento con su nombre y dirección, incluidas las entidades vinculadas a las mencionadas específicamente, no podrán beneficiarse de la exención y estarán sujetos al tipo del derecho residual establecido mediante el Reglamento (CE) no 2597/1999.

(31) The investigation established that Jolybar’s export trade to the Community is long established and the film supplied to the Community is manufactured by the company in facilities established before the entry into force of the measures on Indian PET film. The company explained that as a general rule it does not supply Indian film to Community customers since the latter prefer the qualities of European film as a base material for treatment by Jolybar. Exceptionally, during the IP, a quantity of approximately one tonne of Indian film was shipped to one Community customer as part of a larger consignment which the customer required urgently. It is therefore concluded that there is sufficient economic justification for the development of Jolybar’s exports, which is in line with its activities in the Community market in respect of PET film manufactured by them.

(31) La investigación constató que las actividades de exportación de Jolybar a la Comunidad databan de antiguo y que la empresa fabricaba la película suministrada a la Comunidad en las instalaciones establecidas antes de la entrada en vigor de las medidas sobre las películas de PET indias. La empresa explicó que, por lo general, no suministraba película india a los clientes comunitarios porque éstos prefieren la calidad de los productos europeos como material de base para su transformación por Jolybar. Excepcionalmente, durante el período de investigación, se envió a un cliente de la Comunidad aproximadamente una tonelada de película india que formaba parte de un encargo que el cliente exigía con urgencia. Por lo tanto, se concluye que existe una justificación económica suficiente para la evolución de las exportaciones de Jolybar, que está vinculada a sus actividades en el mercado comunitario relacionadas con las películas de PET fabricadas por la empresa.

(31) The investigation established that Jolybar's export trade to the Community is long established and the film supplied to the Community is manufactured by the company in facilities established before the entry into force of the measures on Indian PET film. The company explained that as a general rule it does not supply Indian film to Community customers since the latter prefer the qualities of European film as base material for treatment by Jolybar. Exceptionally, during the IP, a quantity of approximately one tonne of Indian film was shipped to one Community customer as part of a larger consignment which the customer required urgently. It is therefore concluded that there is sufficient economic justification for the development of Jolybar's exports, which is in line with its activities in the Community market in respect of PET film manufactured by them.

La empresa explicó que por lo general no suministraba película india a los clientes comunitarios porque éstos prefieren las calidades de los productos europeos como material de base para su transformación por Jolybar. Excepcionalmente, durante el período de investigación, se envió a un cliente de la Comunidad aproximadamente una tonelada de película india que formaba parte de un encargo que el cliente exigía con urgencia. Por lo tanto, se concluye que existe una justificación económica suficiente para la evolución de las exportaciones de Jolybar, que está vinculada a sus actividades en el mercado comunitario relacionadas con las películas de PET fabricadas por la empresa.
