1. Se non sono ammessi ricorsi giurisdizionali o se tali ricorsi sono intesi ad accertare soltanto la legittimità dei provvedimenti impugnati o se essi non hanno effetto sospensivo, il provvedimento di diniego del rinnovo del permesso di soggiorno o quello di allontanamento dal territorio del titolare del permesso di soggiorno è adottato dall'autorità amministrativa, tranne in casi di urgenza, solo dopo aver sentito il parere di una autorità competente del paese ospitante, dinanzi alla quale l'interessato deve poter far valere i propri mezzi di difesa e farsi assistere o rappresentare secondo la procedura prevista dalla legislazione di detto paese.

1.
