Whereas, following a restructuring of the Taiwan administration, the competent, authority for health certificates for fishery products has changed from the "BCIQ" to the "Bureau of Standards, Metrology and Inspection (BSMI)" of the Ministry of Economic Affairs and this new authority is capable of effectively verifying the application of the laws in force;

Whereas, pursuant to Article 11 (4) (c) of Directive 91/493/EEC, a list of approved establishments must be drawn up; whereas that list must be drawn up on the basis of a communication from the BCIQ to the Commission; whereas it is therefore for the BCIQ to ensure compliance with the provisions laid down to that end in Article 11 (4) of Directive 91/493/EEC;

(2) W następstwie restrukturyzacji administracji Tajwanu organ właściwy do wystawiania świadectw zdrowia dla produktów rybołówstwa zmienił się z BCIQ na Bureau of Standards, Metrology and Inspection (BSMI) Ministerstwa Spraw Gospodarczych; ten nowy organ jest w stanie skutecznie kontrolować stosowanie obowiązujących ustaw; niezbędna jest zatem zmiana właściwego organu wymienionego w decyzji 94/766/WE.

(2) Whereas, following a restructuring of the Taiwan administration, the competent, authority for health certificates for fishery products has changed from the "BCIQ" to the "Bureau of Standards, Metrology and Inspection (BSMI)" of the Ministry of Economic Affairs and this new authority is capable of effectively verifying the application of the laws in force; whereas it is, therefore, necessary to modify the nomination of the competent authority named by Decision 94/766/EC;

Artykuł 1 decyzji Komisji 94/766/WE z dnia 21 listopada 1994 r. ustanawiającej specjalne warunki przywozu produktów rybołówstwa i akwakultury pochodzących z Tajwanu3, ostatnio zmienionej decyzją 96/255/WE4, stanowi że Bureau of Commodity Inspection and Quarantine (BCIQ) jest organem właściwym na Tajwanie w celu sprawdzania i poświadczania zgodności produktów rybołówstwa i akwakultury z wymaganiami dyrektywy 91/493/EWG.

Whereas Article 1 of Commission Decision 94/766/EC of 21 November 1994 laying down special conditions governing the import of fishery and aquaculture products originating in Taiwan(3) as last amended by Decision 96/255/EC(4), which states that the Bureau of Commodity Inspection and Quarantine (BCIQ) shall be the Competent Authority in Taiwan for verifying and certifying compliance of fishery and aquaculture products with the requirements of Directive 91/493/EEC;

a także mając na uwadze, co następuje:(1) Artykuł 1 decyzji Komisji 94/766/WE z dnia 21 listopada 1994 r. ustanawiającej specjalne warunki przywozu produktów rybołówstwa i akwakultury pochodzących z Tajwanu [3], ostatnio zmienionej decyzją 96/255/WE [4], stanowi że Bureau of Commodity Inspection and Quarantine (BCIQ) jest organem właściwym na Tajwanie w celu sprawdzania i poświadczania zgodności produktów rybołówstwa i akwakultury z wymaganiami dyrektywy 91/493/EWG.
