in its confédération française démocratique du travail decision of 10 july 1978, the commission rejected the claims brought against the member states of the european coal and steel community (ecsc) by a french trade union aggrieved at not being considered for a position on the ecsc consultative committee, on the grounds that the participation of the states in ecsc organs did not constitute an exercise of sovereign powers within the meaning of article 1 of the european convention for the protection of human rights and fundamental freedoms.
