eighteenth report of the secretary-general pursuant to paragraph 14 of resolution 1284 (1999) introduction the present report is submitted pursuant to paragraph 14 of security council resolution 1284 (1999), in which the council requested me to report every four months on the compliance by iraq with its obligations regarding the repatriation or return of all kuwaiti and third-country nationals or their remains. the report provides a brief account of the relevant developments since my last report, of 8 december 2004 (s/2004/961). background during the reporting period, the gulf cooperation council and the league of arab states addressed issues pertaining to the repatriation or return of all kuwaiti and third-country nationals or their remains. at its twenty-fifth session, held in bahrain on 20 and 21 december 2004, the supreme council of the gulf cooperation council condemned the deliberate mass killing of iraqis and of kuwaiti prisoners and detainees as well as nationals of other countries committed by the previous iraqi regime, and their burial in mass graves. it stated that those acts amounted to a flagrant violation of human rights, the principles of islam, moral principles in general, and arab values. in the final communiqué of its seventeenth regular session at the summit level, held at algiers on 22 and 23 march 2005, the council of the league of arab states condemned the serious violations of human rights perpetrated by the former iraqi regime during its occupation of kuwait, particularly with regard to kuwaiti and third-country prisoners and missing persons. the council called for the continuation of efforts to establish the fate and whereabouts of those prisoners and missing persons. it supported referral of the perpetrators of the crimes to the competent iraqi courts. recent activities in a letter dated 21 march 2005, the permanent representative of kuwait to the united nations informed the high-level coordinator, yuli vorontsov, that the total number of identified remains had risen to 222. the names of the identified remains are listed in the annex to the present report, where it is noted that some remains were those of citizens of egypt, the islamic republic of iran, lebanon, oman and saudi arabia. on 21 and 22 march 2005, ambassador vorontsov visited kuwait, where he was received by the minister for foreign affairs, sheikh mohammad al-sabah al-salem al-sabah, and had meetings with members of the kuwaiti national committee for missing persons and prisoners of war affairs and other officials. he was advised that kuwait was determined to continue efforts aimed at disclosing the fate of all kuwaiti prisoners of war and third-country nationals. the kuwaiti authorities often received from sources in iraq and the neighbouring countries information about kuwaiti missing persons and third-country nationals. every piece of information was thoroughly checked by the kuwaiti authorities in the hope that it might lead to the whereabouts of a person who was still alive or a burial site. because of security concerns, the kuwaiti technical teams were unable to continue their work in iraq during the first quarter of 2005. identifications made during the past several months were based on the mortal remains brought to kuwait in 2004. the high-level coordinator assured his interlocutors that he would make every effort to assist in bringing to a close the humanitarian issue of kuwaiti detainees and third-country nationals. while in new york in december 2004, ambassador vorontsov held a meeting with the permanent representative of iraq to the united nations, who assured him of the willingness and determination of the new iraqi authorities to assist in closing the files of kuwaiti missing persons and to cooperate with the high-level coordinator. on 9 march 2005, i received a letter from the minister for foreign affairs of iraq, hoshyar zebari. the minister stressed the desire of the government of iraq to cooperate fully with the high-level coordinator and offer the necessary assistance to enable him to discharge his responsibilities in accordance with the relevant security council resolutions, so that the issues of kuwaiti missing persons and the return of kuwaiti property could be closed. the minister pointed out, among other things, that the process of searching for missing persons continued with the best of intentions and goodwill. the ministry of foreign affairs of iraq had published in the media, including local newspapers, the names and photographs of missing persons whose remains had not yet been found and requested citizens to report any relevant information to the competent iraqi authorities. in my fifteenth report, dated 16 april 2004 (s/2004/301), i referred to the issue of compensation to family members of 605 former detainees in iraq determined to be deceased. at its fifty-fifth session, on 10 march 2005, the governing council of the united nations compensation commission approved the report and recommendations made by the panel of commissioners concerning the claims with regard to 605 former detainees in iraq. the government of kuwait had withdrawn two of the claims. of the 603 claims reviewed (seeking a total of approximately us$ 259 million), 602 were approved by the council for compensation, with a total award value of $161 million. the claims comprised the losses personally suffered by the deceased detainees, including claims for forced departure, loss of property and business losses, as well as the loss of financial support and mental pain and anguish suffered by their families. according to the commission's procedures for the distribution of awards, $100,000 will be made available for distribution to each of the families in the next round of payments, scheduled for april 2005. observations given the difficult security situation in iraq, the search for the kuwaiti prisoners of war and third-country nationals or their remains in iraq has not progressed substantially since the submission of my last report. however, the process of identification of mortal remains has continued. i support the determination of the government of kuwait to pursue the issue of kuwaiti prisoners of war and third-country nationals until all files are closed. the fate of some 270 missing persons is not yet known but, regrettably, the chances that they may be found alive have diminished with time. again, i strongly condemn the execution of kuwaiti and third-country nationals by the previous iraqi regime in violation of human rights and international humanitarian law. i call on the newly installed government of iraq to ensure that those responsible for these despicable crimes are brought to justice. i am pleased to note a constructive stance taken by the new iraqi authorities when it comes to meeting the international obligations of iraq with regard to the repatriation or return of all kuwaiti and third-country nationals or their remains and the return of property in accordance with paragraph 14 of resolution 1284 (1999). concrete actions have been taken to that end and i hope that they will bring results. the assistance provided by the multinational force in iraq in the search for the kuwaiti and third-country missing persons is greatly valued. the high-level coordinator will continue to maintain close contacts with the government of kuwait and the tripartite commission, which remains the most appropriate mechanism to deal with the issues in question. he will continue his dialogue with the iraqi التقرير الثامن عشر المقدم من الأمين العام عملا بالفقرة 14 من القرار 1284 (1999) أولا - مقدمة 1 - يقدّم هذا التقرير عملا بالفقرة 14 من قرار مجلس الأمن 1284 (1999)، التي طلب إليَّ فيها المجلس أن أُقدم تقريرا كل أربعة أشهر عن امتثال العراق لالتزاماته فيما يتعلق بإعادة أو عودة جميع الكويتيين ورعايا البلدان الأخرى أو رفاتهم إلى أوطانهم. ويقدم هذا التقرير سردا موجزا للتطورات ذات الصلة بالموضوع منذ آخر تقرير لي في هذا الصدد، وهو التقرير المؤرخ 8 كانون الأول/ديسمبر 2004 (s/2004/961). ثانيا - معلومات أساسية 2 - خلال الفترة المشمولة بالتقرير، تناول مجلس التعاون لدول الخليج العربية وجامعة الدول العربية المسائل المتعلقة بإعادة أو عودة جميع الكويتيين ورعايا البلدان الأخرى أو رفاتهم إلى أوطانهم. وأدان المجلس الأعلى لمجلس التعاون لدول الخليج العربية، في دورته الخامسة والعشرين المعقودة في البحرين يومي 20 و21 كانون الأول/ديسمبر 2004، ما ارتكبه النظام العراقي السابق من قتل جماعي متعمد للأسرى والمحتجزين العراقيين والكويتيين وكذلك لرعايا البلدان الأخرى، ودفنهم في مقابر جماعية. وأكد المجلس أن هذه الأعمال بمثابة انتهاك سافر لحقوق الإنسان ومبادئ الإسلام والمبادئ الأخلاقية العامة والقيم العربية. 3 - كما أن البيان الختامي للدورة العادية السابعة عشرة لاجتماع مجلس جامعة الدول العربية، الذي عقد على مستوى القمة في يومي 22 و 23 آذار/مارس 2005، أدان الانتهاكات الخطيرة لحقوق الإنسان التي ارتكبها النظام العراقي السابق أثناء احتلاله للكويت، ولا سيما فيما يتعلق بالأسرى والمفقودين من الكويتيين ومن رعايا البلدان الأخرى. وطالب المجلس بمواصلة الجهود لمعرفة مصير وأماكن وجود أولئك الأسرى والمفقودين. وأيّـد البيان إحالة مرتكبي هذه الجرائم إلى المحاكم العراقية المختصة. ثالثا - الأنشطة المضطلع بها مؤخرا 4 - في رسالة مؤرخة 21 آذار/مارس 2005، أبلغ الممثل الدائم للكويت لدى الأمم المتحدة المنسق الرفيع المستوى، يولي فورونتسوف، أن العدد الإجمالي للرفات الذي أمكن التعرف على هويات أصحابه ارتفع إلى 222. وترد أسماء الذين تم التعرف على هوياتهم في مرفق هذا التقرير الذي يشير إلى أن بعض الرفات لمواطنين من جمهورية إيران الإسلامية وعمان ولبنان ومصر والمملكة العربية السعودية. 6 - وفي 21 و 22 آذار/مارس 2005، زار السفير فورونتسوف الكويت، حيث استقبله الشيخ محمد الصباح السالم الصباح، وزير الخارجية، واجتمع مع أعضاء اللجنة الوطنية الكويتية لشؤون المفقودين وأسرى الحرب ومسؤولين آخرين. وأُبلغ السفير أن الكويت عازمة على مواصلة الجهود الرامية إلى الكشف عن مصير جميع أسرى الحرب من الكويتيين ومن رعايا البلدان الأخرى. وقد تلقت السلطات الكويتية في حالات كثيرة من مصادر من العراق ومن بلدان مجاورة معلومات عن المفقودين من الكويتيين ومن رعايا البلدان الأخرى. وقامت السلطات الكويتية بتمحيص كل شذرة من المعلومات بدقة، أملا في أن تفضي إلى اكتشاف مكان وجود شخص ما زال على قيد الحياة أو البقعة التي وُري الثرى فيها. وبسبب الشواغل الأمنية في العراق، لم تتمكن الفرق التقنية الكويتية من مواصلة عملها هناك خلال الربع الأول من عام 2005. أما عمليات التعرف على الرفات التي اضطلع بها خلال العدة شهور الأخيرة فقد استندت إلى الرفات الذي نقل إلى الكويت في عام 2004. وأكد المنسق الرفيع المستوى لمحاوريه أنه لن يدخر أي جهد للمساعدة في حل القضية الإنسانية للمحتجزين من الكويتيين ومن رعايا البلدان الأخرى. 6 - وفي نيويورك في كانون الأول/ديسمبر 2004، عقد السفير فورونتسوف اجتماعا مع الممثل الدائم للعراق لدى الأمم المتحدة، الذي أكد له رغبة السلطات العراقية الجديدة وعزمها على المساعدة في إغلاق ملفات المفقودين الكويتيين والتعاون مع المنسق الرفيع المستوى. 7 - وفي 9 آذار/مارس 2005، تلقيت رسالة من السيد هوشيار زيباري، وزير خارجية العراق، الذي شدد على رغبة الحكومة العراقية في التعاون الكامل مع المنسق الرفيع المستوى وتقديم المساعدة اللازمة لتمكينه من النهوض بمسؤولياته وفقا لقرارات مجلس الأمن ذات الصلة، حتى يتسنى إنهاء قضايا المفقودين الكويتيين وإعادة الممتلكات الكويتية. وأشار الوزير في جملة أمور إلى أن عملية البحث عن المفقودين تتواصل بأخلص وأصدق النوايا. ونشرت وزارة خارجية العراق عبر وسائط الإعلام، بما في ذلك الصحف المحلية، أسماء وصور المفقودين الذين لم يُعثر على رفاتهم بعد، وطلبت إلى المواطنين إبلاغ السلطات العراقية المختصة بأي معلومات ذات صلة في هذا الموضوع. 8 - وقد أشرت في تقريري الخامس عشر المؤرخ 16 نيسان/أبريل 2004 (s/2004/301)، إلى مسألة تعويض أفراد عائلات 605 من المحتجزين السابقين في العراق ممن تأكدت وفاتهم. وخلال الدورة الخامسة والخمسين لمجلس إدارة لجنة الأمم المتحدة للتعويضات المعقودة في 10 آذار/مارس 2005، صدّق المجلس على التقرير وعلى التوصيات المقدمة من فريق المفوضين بشأن المطالبات المتعلقة بالمحتجزين السابقين في العراق البالغ عددهم 605 محتجزا. وقد سحبت الحكومة الكويتية مطالبتين من هذه المطالبات. ووافق مجلس إدارة لجنة التعويضات على 602 من المطالبات من أصل 603 مطالبات (التي تطالب بما مجموعه 259 مليون دولار من دولارات الولايات المتحدة تقريبا)، حيث تبلغ قيمة التعويضات الإجمالية 161 مليون دولار. 9 - وتشمل المطالبات الخسائر التي تكبدها شخصيا المحتجزون المتوفون (بما في ذلك المطالبات المتعلقة بالترحيل القسري، وفقدان الممتلكات، والخسائر التجارية)، وكذلك ما عانته عائلاتهم من فقدان الدعم المالي والألم النفسي والحزن. ووفقا لإجراءات اللجنة المتعلقة بتوزيع التعويضات، سيتاح للتوزيع على كل عائلة من العائلات المعنية مبلغ 000 100 دولار خلال الجولة المقبلة من دفع التعويضات المقررة في نيسان/أبريل 2005. رابعا - ملاحظات 10 - نظرا لصعوبة الوضع الأمني في العراق، لم يُحرز تقدم كبير في البحث عن أسرى الحرب من الكويتيين ومن رعايا البلدان الأخرى أو رفاتهم منذ تقديم تقريري الأخير. غير أن عملية التعرف على الرفات استمرت. وأؤيد عزم حكومة الكويت على متابعة قضية أسرى الحرب من الكويتيين ومن رعايا البلدان الأخرى حتى تغلق جميع الملفات. ولا يزال يُجهل مصير نحو 270 مفقودا, رغم أن فرص العثور عليهم أحياء تضاءلت مع الأسف بمرور الوقت. 11 - وأُعربُ مجددا، عن إدانتي الشديدة لقتل النظام العراقي السابق للكويتيين ورعايا البلدان الأخرى، في انتهاك لحقوق الإنسان وللقانون الإنساني الدولي. وأدعو حكومة العراق المشكلة حديثا إلى ضمان تقديم المسؤولين عن هذه الجرائم الدنيئة إلى العدالة. 12 - ويسعدني أن ألاحظ الموقف البناء الذي اتخذته السلطات العراقية الجديدة بخصوص الوفاء بالتزامات العراق الدولية فيما يتعلق بإعادة أو عودة جميع الكويتيين ورعايا البلدان الأخرى أو رفاتهم إلى أوطانهم وإعادة الممتلكات وفقا للفقرة 14 من القرار 1284 (1999). وقد اتخذت إجراءات ملموسة تحقيقا لهذه الغاية وآمل أن تؤتى أُكلَها. 13 -
