ويُكلف مجلس الرئاسة المرشح لمنصب رئيس مجلس الوزراء من بين الكتلة النيابية التي حصلت على أكبر عدد من مقاعد مجلس النواب لتشكيل الوزارة في غضون 15 يوما ابتداء من تاريخ انتخاب مجلس الرئاسة.

168 - إن الحد الأقصى المطروح لهذا التفسير يمكن أن يكون 15 للأكثرية + 10 للمعارضة + 5 للرئيس (وجهة نظر الأكثرية) والحد الأدنى كما تطرحه المعارضة هو 10 + 10 + 10 وفي كل الأحوال، فإن المعارضة لن يكون باستطاعتها الحصول على الثلث + 1، والأكثرية لا يمكن أن تحصل على النصف + 1، كما أن هذا التفسير لا يمنع من مناقشة مطلب الأكثرية بمقاعد وزارية أكثر من المعارضة لكونها وبحكم العرف المعمول به في تشكيل الحكومات تمتلك أكثرية المقاعد في مجلس النواب، كما أنه لا يمنع مناقشة اقتراح المعارضة توزيع الحقائب الوزارية طبقا لنسبة تمثيل الكتل النيابية في البرلمان.
168. the maximum proposal under this interpretation could be 15 for the majority, 10 for the opposition and 5 for the president (the view of the majority), while the minimum, as proposed by the opposition, is 10+10+10. in any event, the opposition will be unable to obtain one-third plus one and the majority cannot obtain one-half plus one. this interpretation does not preclude discussion of the majority demand for more seats in the cabinet than the opposition given that it, and by virtue of the convention applied in forming governments, holds a majority of the seats in the national assembly. likewise, it does not preclude discussion of the opposition proposal for a distribution of ministerial portfolios in line with the ratio of representation of the factions in parliament.
