the state party should review its rules and provisions on the statute of limitations and bring them fully in line with its obligations under the convention so that acts of torture, attempts to commit torture, and acts by any person which constitute complicity or participation in torture, can be investigated, prosecuted and punished without time limitations.

67- أولى المشرع الجنائي اهتمامه بتنظيم مسألة انقضاء الدعوى الجنائية بمضي المدة في قانون الإجراءات الجنائية, وتختلف المدة المقررة للتقادم من جريمة إلى أخرى بالنظر إلى خطورة الجريمة المرتكبة وحسب كونها جناية أو جنحة، وذلك على النحو التالي بيانه.
67. the criminal legislator regulates the statute of limitations on offences through the provisions of the code of criminal procedures. the statute of limitations varies from one offence to another, depending on the gravity of the offence, i.e. whether it is a serious or a lesser offence. further details are provided below.

وفي حين تلاحظ اللجنة المعلومات المقدمة من الوفد التي تفيد بأن قانون التقادم سيخضع إلى إعادة النظر فيه، فإنها تعرب عن قلقها من أن سقوط الدعوى بالتقادم المطبق على أحكام القانون الجنائي قد يحول دون إجراءات التحقيق والمحاكمة والمعاقبة على هذه الجرائم الخطيرة، لا سيما إذا كان الفعل الذي يستوجب العقاب قد أرتُكب في الخارج.
while noting information provided by the delegation that a review of the statute of limitations will be conducted, the committee is concerned that the statute of limitations applicable to provisions of the criminal code may prevent investigation, prosecution and punishment of these grave crimes, in particular when the punishable act has been committed abroad.
