2005. szeptember 15-én kelt levelében a ciprusi képviselőház környezetvédelmi bizottságának elnöke az ek-szerződés 95. cikkének (5) bekezdése értelmében értesítést küldött az európai uniónak az élelmiszerekre (ellenőrzés és értékesítés) vonatkozó 1996–2005 közötti törvények (az úgynevezett „alaptörvények”) módosításáról szóló 2005-ös törvénytervezetről (a továbbiakban: törvénytervezet), amely úgy rendelkezik, hogy – az 1829/2003/ek [1] és az 1830/2003/ek [2] európai parlamenti és tanácsi rendelet rendelkezéseitől eltérve – az üzletközpontokban a géntechnológiával módosított élelmiszereket külön erre a célra berendezett helyen, a géntechnológiával nem módosított élelmiszerek által elfoglalt polcsoroktól elkülönített részen kell elhelyezni.
by letter of 15 september 2005, the chairman of the cypriot house of representatives committee on the environment notified the european union, pursuant to article 95(5) of the ec treaty, of a 2005 legislative bill (hereinafter ‘the bill’) amending the laws of 1996 to 2005 on foods (control and sale) (referred to as the ‘basic law’) imposing on supermarkets an obligation to place genetically modified foods in a specially designated place on their shelves separate from non-genetically modified foods, in derogation of the provisions of regulations (ec) no 1829/2003 [1] and (ec) no 1830/2003 [2] of the european parliament and of the council.
