(149) německo mimo to na další dotaz komise uvádí, že i při sledování tzv. ratingu finanční síly prostřednictvím moody's investors'service a tzv. individuálního ratingu fitch pro společnost helaba v relevantním časovém období nemohl být pozorován žádný vliv vkladu tichého společníka na klasifikaci finanční síly společnosti helaba. oba uvedené ratingy se bez ohledu na stávající státní ručení formou institucionální odpovědnosti úvěrového ústavu a ručení zřizovatele a vlastnickými strukturami řídí výlučně a bezprostředně výnosností příslušného ústavu, kvalitou jeho managementu, postavením na trhu a také vybavením vlastním kapitálem [21] odpověď německa ze dne 23. června 2004, s. 12, příloha 29/2004, fitch ratings: bank rating methodology: may 2004, s. 12: "principal considerations are profitability, balance sheet integrity (including capitalisation), franchise, management, operating environment, consistency, as well as size (in terms of a bank's equity capital)".. oba uvedené ratingy zůstaly od roku 1997 do 2000, a tedy přes vložení vkladu tichého společníka na konci roku 1998 nezměněné (moody's rating finanční síly c+ a fitch individuální rating b/c) a od roku 2001 (moody's rating finanční síly c+ (neg.) popř. c(neg.) a fitch individuální rating c) se zhoršovaly. toto podle názoru německa dokládá, že vklad tichého společníka neměl žádný vliv na schopnost společnosti helaba splácet úvěr i bez ohledu na stávající státní ručení [22] důvod spočívá, jak již bylo uvedeno, v jasném přeplnění minimálních norem z hlediska právního dohledu pro kapitálové podíly (podíl základního kapitálu ve výši 4,0%, celková charakteristika popř. podíl vlastních prostředků 8,0%) v relevantním období, v čemž pravděpodobně spočívá důležitý rozdíl vzhledem k situaci společnosti westlb. v roce 1997, tzn. před vložením vkladu, podle zásady i k § 10a zákona o bankách činila charakteristika základního kapitálu pro koncern helaba 4,8% a pro jednotlivý ústav helaba 5,0%. podle zásady banky pro mezinárodní zúčtování plateb činil podíl základního kapitálu (tier i) 1997 5,4%. celková charakteristika popř. podíl vlastních prostředků činil v roce 1997 8,9% popř. 9,6% pro koncern a 9,2% pro jednotlivý ústav. také na pozadí obchodního růstu plánovaného pro následující obchodní léta ze strany společnosti helaba neexistovala žádná bezprostřední nutnost přijetí základního kapitálu v částce 1264,4 mil. eur..

Így 1997-ben, vagyis a tőkejuttatást megelőzően, a kwg 1-10a. cikkének alapelve szerint, az alaptőke-index a helaba-konszern esetében 4,8%-on, a helaba mint egyéni intézmény esetében 5,0% volt. a nemzetközi fizetések bankjának alapelvei szerint, az alaptőke-hányad (1. osztály) 1997-ben 5,4%-ot tett ki. az egyesített mutató, illetve sajáteszköz-hányad 1997-ben 8,9%, illetve a konszernre vonatkoztatva 9,6%, míg az egyéni intézmény tekintetében 9,2% volt. még a helaba részéről a következő üzleti évekre megcélzott üzleti növekedés fényébe sem állt fenn az 1264,4 millió euró összegű alaptőke-felvétel közvetlen szükségessége.. a fentemlített minősítés 1997-2000 között – és az 1998. év végi csendestársi tőkejuttatás befogadása ellenére – változatlan maradt (a moody’s pénzügyierő-értékelése: c+ és a fitch egyéni értékelése: b/c; 2001-től (a moody’s pénzügyierő-értékelése: c+ (neg), illetve c(neg.)-re és a fitch egyéni értékelése: c-re gyengült. ez – németország nézete szerint – azt jelenti, hogy a csendestársi tőkebefektetés, a fennálló állami garanciák mellett sem volt hatással a helaba hitelképességére.
