diese pinguinart ist als „bedroht“ klassifiziert in der liste der bedrohten arten (iucn-red list) und in anhang i nach cites. sie ist auch geschützt durch die konvention zur biodiversität (convenio de biodiversidad –cbd)unddurch chilenisches recht. neben der großen bedeutung für den fischfang wurde dieses meeresgebiet auch deshalb als schutzgebiet ausgewiesen, weil es der lebensraum zahlreicher anderer, auch endemischer und bedrohter arten (iucn / anhang i nach cites) ist wie garnot-sturmvogel (pelecanoides garnoti), guanotölpel (sula variegata), meeresotter (lontra felina), buckelwal (metaptera novaeangliae) und großer tümmler (tursiops truncatus).diese delfinart lebt hier sogar während des ganzen jahres und ist somit die einzige residente stabile kolonie in chile. auch andere arten von walen und delfinen halten sich regelmässig hier auf und nutzen das gebiet zur rast und nahrungssuche.
