"artikel 10a i rådets förordning (eeg) nr 1408/71 av den 14 juni 1971 om tillämpningen av systemen för social trygghet när anställda, egenföretagare etter deras familjer flyttar inom gemenskapen, i dess ändrade och uppdaterade lydelse enligt rådets förordning (eeg) nr 2001183 av den 2 juni 1983, i dess ändrade lydelse enligt förordning (eeg) nr 1247/92 av den 30 april 1992, jämförd med bilaga Π a, skatt tolkas sä att 'attendance allowance' omfattas av artikelns tillämpningsområde och följaktligen är en särskild icke avgiftsfinansierad förmån i den mening som avses i artikel 4.2a i samma förordning, vaket innebär att då en person, i likhet med sökanden i målet vid den nationella domstolen, har uppfyllt villkoren för att beviljas denna förmån efter den ljum 1992, när förordning nr 1247/92 trädde i kraft, skatt hans situation uteslutande regleras av det samordningssystem som har införts genom artikel 10a."
'on a proper construction of article 10a of council regulation (eec) no 1408/71 of 14 june 1971 on the application of social security schemes to employed persons, to self-employed persons and to members of their families moving within the community, as amended and updated by council regulation (eec) no 2001/83 of 2 june 1983, as subsequently amended by council regulation (eec) no 1247/92 of 30 april 1992, read in conjunction with annex ha, attendance allowance falls within the scope of that provision and is therefore a special noncontributory benefit within the meaning of article 4(2a) of that regulation, with the result that the position of a person, such as the applicant in the main proceedings, who satisfied the conditions for the award of that benefit after 1 june 1992 when regulation no 1247/92 entered into force, is governed exclusively by the system of coordination established by the said article 10a.'
