in order to take account of technical developments on financial markets and to ensure uniform application of this directive, the commission shall, in accordance with the procedure referred to in article 24(2), adopt implementing measures concerning the dissemination of advertisements announcing the intention to offer securities to the public or the admission to trading on a regulated market, in particular before the prospectus has been made available to the public or before the opening of the subscription, and concerning paragraph 4.

aif-förvaltare får emellertid, i den mån de förvaltar slutna aif-fonder där teckningstiden för investerarna har löpt ut innan direktivet träder i kraft och som upprättas för en tidsperiod som löper ut senast tre år efter den 22 juli 2013 fortsätta att förvalta sådana aif-fonder utan att följa detta direktiv, med undantag för artikel 22 och, i tillämpliga fall, artiklarna 26–30, eller ansöka om auktorisation enligt detta direktiv.
aifms in so far as they manage aifs of the closed-ended type whose subscription period for investors has closed prior to the entry into force of this directive and are constituted for a period of time which expires at the latest 3 years after 22 july 2013, may, however, continue to manage such aifs without needing to comply with this directive except for article 22 and, where relevant, articles 26 to 30, or to submit an application for authorisation under this directive.
