لما كان ذلك؛ وكان الثابت بالأوراق أن الحكم الصادر في الاستئناف رقم ‎2021/1067‏ جزاء قد صدر حضورياً في حق أحد المتهمين (ياسر محمد صالح العقيلي)

وحيث إن هذا النعي في محله؛ ذلك أن من المقرر - في قضاء هذه المحكمة - أنه ولئن كان لمحكمة الموضوع السلطة التامة في تحصيل فهم الواقع في الدعوى إلا أن ذلك مشروط بأن يكون قضاؤها سائغاً ومبنياً على ما له أصله الثابت بالأوراق بما يكفي لحمله،
whereas this objection is valid and - as per the rulings of the present court - while the trial court may have the absolute power to concede the facts, this is conditional on that the court's rulings reasonable and based on such a sufficient proof in documents as to be counted on,

وحيث إن هذا النعي في غير محله، ذلك أن قضاء هذه المحكمة استقر على أن فهم تحصيل الواقع في الدعوى وتقدير أدلتها وإستخلاص تحقق الشرط الواقف وتسليم المبيع وإحالة الدعوى إلى الخبرة، هي من المسائل الموضوعية التي تستقل بها محكمة الموضوع بغير معَّقب عليها في ذلك من المحكمة الاتحادية العليا طالما كان تحصيلها وإستخلاصها سائغاً وله أصله الثابت بالأوراق ويكفي لحمل قضائها.
whereas this objection is not valid, since - as per the rulings of the present court - understanding the facts of claim, assess the evidence therein, concluding that the condition precedent was met, and the case was assigned to experts are objective matters over which the trial court has jurisdiction without restrictions by the federal supreme court so long as the understanding and deduction are based on reasonable grounds as related to the documents and sufficient for its judgment.

وحيث إن الطاعن ينعي بسبب الطعن على الحكم المطعون فيه مخالفة القانون والثابت بالأوراق والفساد في الاستدلال من خمسة أوجه: حاصل الوجه الأخير منها عدم سداد المطعون ضده رسوم الاستئناف في حينه رغم يساره، بما يعيب الحكم ويستوجب نقضه.
whereas the cassation was based on failure in violating the law, the mentioned evidence on documents and the error at evidences in five aspects: the last one of them is that the respondent has not paid the appeal fees at time despite its low cost which erred the judgment and therefore necessitates its cassation.
