za těchto okolností se bundesverwaltungsgericht rozhodl přerušit řízení a položit soudnímu dvoru následující předběžné otázky:

s ohledem na výše uvedené úvahy navrhuji soudnímu dvoru, aby na otázky položené bundesverwaltungsgericht odpověděl následovně:
in the light of the foregoing, it is suggested that the court answer the questions asked by the bundesverwaltungsgericht as follows:

toto nařízení však spolkový správní soud (bundesverwaltungsgericht) prohlásil za protiprávní a nařízení proto nenabylo platnosti.
instead it used the minimum wage for the postal sector based on a regulation issued by the federal ministry for labour in 2007 (hereafter referred to as 2007 minimum wage). however, it has to be noted that that regulation was finally declared illegal by the federal administrative court and never became legally effective.

s ohledem na veškeré výše uvedené úvahy navrhuji soudnímu dvoru, aby odpověděl na předběžné otázky položené bundesverwaltungsgericht takto:
in the light of the foregoing considerations, i propose that the court should reply to the questions referred for a preliminary ruling by the bundesverwaltungsgericht, declaring that:
