74- وتطبيقاً لهذا الأمر على أرض الواقع حددت المحكمة الدستورية في حيثيات قرارها في القضية الدستورية رقم مد/قد/41/2007 بتاريخ 21 أيلول/سبتمبر 2009 في قضية العمدة حسين اسحق يحيى ساجو وآخرين ضد حكومة السودان ووالي ولاية شمال دارفور: "ولكن في كل الأحوال يجب أن يتضمن قرار إعلان حالة الطوارئ ثلاث نقاط رئيسية: (1) بيان الحالة التي أعلنت حالة الطوارئ بسببها؛(2) تحديد المنطقة التي يشملها الإعلان؛(3) تاريخ بدء سريانها ومدة السريان.
