overwegende dat de bescherming van de consument vereist dat schade veroorzaakt door dood of lichamelijk letsel en materiële schade worden vergoed; dat deze laatste schadevergoeding evenwel beperkt moet blijven tot zaken voor ge- of verbruik in de privésfeer en dat daarop een franchise van een vast bedrag moet worden toegepast; zulks om te voorkomen dat er al te veel geschillen ontstaan; dat deze richtlijn het uitkeren van smartegeld en vergoeding van andere vormen van onstoffelijke schade, waarin het ter zake van toepassing zijnde recht in voorkomend geval voorziet, onverlet laat;
