(5) where any guarantor company, being a company which is incorporated in any state or territory nominated for the purposes of this section by the minister, has lodged with the appropriate authority in any such nominated state or territory a profit and loss account and balance sheet for the relevant period, that shall be sufficient compliance with the requirements of subsection (4) if, with the consent of the trust company acting as trustee for the holders of the debentures of the borrowing company, there is lodged with the registrar and the trust company certified copies of the profit and loss account and balance sheet so lodged.
(5) حيثما تودع أي شركة ضامنة، بصفتها شركة مرخص بها في أي دولة أو إقليم تم تعيينه لأغراض هذا القسم من قبل الوزير، لدى السلطة المختصة في مثل هذه الدولة أو الإقليم المعين حساباً بالأرباح والخسائر وميزانية عمومية عن تلك الفترة المعنية، بما يشكل التزاماً وافياً بشروط القسم الفرعي (4) إذا كانت هناك نسخ معتمدة من حساب الأرباح والخسائر والميزانية العمومية مودعة لدى الموثق وشركة الائتمان، وذلك بموافقة شركة الائتمان التي تتصرف بصفتها أميناً على حاملي سندات الشركة المقترضة.
