esitatud põhjendustest lähtudes teen euroopa kohtule ettepaneku vastata bayerisches verwaltungsgericht müncheni esitatud eelotsuse küsimustele järgmiselt:
in the light of the foregoing considerations, i propose that the court of justice reply as follows to the questions referred for a preliminary ruling by the bayerisches verwaltungsgericht munchen:

olemasolevaid fakte ja teavet arvesse võttes on siiski leitud, et nime "bayerisches bier" registreerimine ei eksita tarbijat toote tegeliku määratluse osas.
in view of the facts and information available, it was, however, considered that registration of the name "bayerisches bier" was not liable to mislead the consumer as to the true identity of the product.

hoolimata geograafilise tähise "bayerisches bier" registreerimisest, võib teatavate kaubamärkide, näiteks hollandi kaubamärgi "bavaria" ja taani kaubamärgi "høker bajer", kasutamist jätkata seni, kuni need vastavad määruse (emÜ) nr 2081/92 artikli 14 lõikega 2 ettenähtud tingimustele.
the use of certain trade marks, for example, the dutch trade mark "bavaria" and the danish trade mark "høker bajer" may continue notwithstanding the registration of the geographical indication "bayerisches bier" as long as they fulfil the conditions provided for in article 14(2) of regulation (eec) no 2081/92.
