het hotelbedrijf mag zijn onderhavige bevoegdheid slechts uitoefenen indien de aard en de ernst van de door de gast begane overtredingen daartoe naar het redelijk oordeel van het hotelbedrijf voldoende aanleiding geven.
the hotel establishment may only exercise this right if the nature and seriousness of the breaches of the house rules by the guest give sufficient cause, in the reasonable opinion of the hotel establishment.

door in naam en voor rekening van een ander handelende tussenpersonen verrichte diensten die bestaan in bemiddeling bij het verstrekken van accommodatie in het hotelbedrijf of in sectoren met een soortgelijke functie vallen onder:

the provision of accomodation, as defined in the laws of the member states, in the hotel sector or in sectors with a similar function, including the provision of accomodation in holiday camps or on sites developed for use as camping sites;

om praktische redenen dient te worden verduidelijkt dat telecommunicatiediensten, omroepdiensten of langs elektronische weg verrichte diensten die door een belastingplichtige in eigen naam worden verricht in samenhang met de verstrekking van accommodatie in het hotelbedrijf of in sectoren met een soortgelijke functie, voor het bepalen van de plaats van de dienst dienen te worden behandeld als zijnde verricht op deze plaatsen.
for practical reasons, it should be clarified that telecommunications, broadcasting or electronically supplied services provided by a taxable person acting in his own name in connection with the provision of accommodation in the hotel sector or sectors with a similar function should be regarded, for the purpose of determining the place of supply, as being supplied at those locations.

de commissie wees er daarnaast op dat deze verplichting ook werd bevestigd in haar beschikking van 1998 waarin zij aangaf geen bezwaar te maken tegen de regionale steunregeling ten behoeve van het hotelbedrijf in de regio sardinië (n 272/1998).
