wewnątrzwspólnotowe nabycie towarów uważa się za dokonane w momencie, w którym uznawana jest za dokonaną dostawa podobnych towarów na terytorium kraju.
the intra-community acquisition of goods shall be regarded as being effected when the supply of similar goods is regarded as being effected within the territory of the country.

an intra-community acquisition of goods shall be deemed to be made by the taxable person to whom those goods are supplied in the member state to which the goods were dispatched or transported.

"wewnątrzwspólnotowe nabycie towarów" oznacza nabycie prawa do rozporządzania ruchomością jako właściciel na mocy art. 28a ust. 3 dyrektywy 77/388/ewg;
"intra-community acquisition of goods", means acquisition of the right to dispose as owner of movable tangible property under article 28a(3) of directive 77/388/eec;

przepisy art. 41 akapit pierwszy nie mają zastosowania, a wewnątrzwspólnotowe nabycie towarów zostaje uznane za opodatkowane vat zgodnie z art. 40, w przypadku gdy spełnione są następujące warunki:
the first paragraph of article 41 shall not apply and vat shall be deemed to have been applied to the intra-community acquisition of goods in accordance with article 40 where the following conditions are met:

w ten sposób państwo członkowskie, na terytorium którego dokonane zostaje wewnątrzwspólnotowe nabycie, nie zostaje poinformowane o wprowadzeniu towaru na jego terytorium.
this way the member state where the intra-community acquisition is located is not informed that goods arrive on its territory.

"the intra-community acquisition of goods shall be regarded as being made, and vat shall become chargeable, when the supply of similar goods is effected within the territory of the relevant member state."

do celów statystycznych, leasing finansowy traktowany jest jako pożyczki udzielone przez finansującego na rzecz korzystającego( umożliwiające nabycie towarów trwalych).
for statistical purposes, financial leases are treated as loans from the lessor to the lessee( enabling the lessee to purchase the durable good).

w przypadku kredytu udzielonego na nabycie towarów państwa członkowskie ustanawiają warunki, na jakich towary mogą być odzyskane, szczególnie jeśli konsument nie wyraził swojej zgody;
whereas, in the case of credit granted for the acquisition of goods, member states should lay down the conditions in which goods may be repossessed, particularly if the consumer has not given his consent;

d) w celu dokonania odliczenia, o którym mowa w art. 168 lit. d), w odniesieniu do transakcji uznawanych za wewnątrzwspólnotowe nabycie towarów, musi dopełnić formalności określonych przez każde państwo członkowskie;
(d) for the purposes of deductions pursuant to article 168(d), in respect of transactions treated as intra-community acquisitions of goods, he must complete the formalities as laid down by each member state;

kredytodawca i dostawca towarów lub usług mają wcześniej zawarte umowy, na podstawie których kredyt jest udostępniany wyłącznie przez tego kredytodawcę klientom tego dostawcy na nabycie towarów lub usług od tego dostawcy;
the creditor and the supplier of the goods or services have a pre-existing agreement whereby credit is made available exclusively by that creditor to customers of that supplier for the acquisition of goods or services from that supplier;

"jeżeli po dokonaniu wewnątrzwspólnotowego nabycia towarów nabywca otrzymuje zwrot podatku akcyzowego zapłaconego w państwie członkowskim, z którego wysłano lub transportowano towary, podstawa opodatkowania zostaje odpowiednio obniżona w państwie członkowskim, w którym nastąpiło wewnątrzwspólnotowe nabycie towarów";
'when, after the moment the intra-community acquisition of goods was effected, the acquirer obtains the refund of excise duties paid in the member state from which the goods were dispatched or transported, the taxable amount shall be reduced accordingly in the member state where the intra-community acquisition took place.`;

państwa członkowskie podejmują środki, aby zapewnić, że jako wewnątrzwspólnotowe nabycie towarów obowiązują transakcje, które obowiązywałyby jako dostawa towarów określone w ust. 5 lub w art. 5, jeżeli byłyby wykonane na terytorium kraju przez podatnika, działającego w takim charakterze.
member states shall take measures to ensure that transactions which would have been classed as ''supplies of goods" as defined in paragraph 5 or article 5 if they had been carried out within the territory of the country by a taxable person acting as such are classed as ''intra-community acquisitions of goods".

„wewnątrzwspólnotowe nabycie towarów” oznacza nabycie prawa do rozporządzania jak właściciel rzeczowym majątkiem ruchomym wysyłanym lub transportowanym do nabywcy przez sprzedawcę, przez nabywcę lub na ich rzecz, do miejsca przeznaczenia w państwie członkowskim innym niż państwo członkowskie rozpoczęcia wysyłki lub transportu towarów.
‘intra-community acquisition of goods’ shall mean the acquisition of the right to dispose as owner of movable tangible property dispatched or transported to the person acquiring the goods, by or on behalf of the vendor or the person acquiring the goods, in a member state other than that in which dispatch or transport of the goods began.
