a challenged arbitrator has withdrawn from office;

jei kita šalis nesutinka su nušalinimu arba jei arbitras, kuriam pareikštas nušalinimas, neatsistatydina, sprendimas dėl nušalinimo priimamas tokia tvarka:
if the other party does not agree to the challenge, or if the challenged arbitrator does not withdraw, a decision on the challenge shall be made as follows:

nepaisant to, kad kita šalis nepritarė nušalinimui, arba arbitras, kuriam buvo pareikštas nušalinimas, nesutiko atsistatydinti, pareiškimo nušalinti nebuvo atsisakyta;
notwithstanding the absence of agreement of the other party, or a refusal by the challenged arbitrator to withdraw, a challenge to an arbitrator is sustained;

iii ) jeigu trečiojo pažeidimo atveju trūkstamo užstato arba pinigų suma sudaro nuo 80 iki 100 % visos teiktinos užstato arba pinigų sumos , taikomas trijų mėnesio nušalinimas .
15.7.2002 ( iii ) if the amount of non-delivered collateral or cash is between 80 % and 100 % of the total collateral or cash to be delivered on the occasion of the third infringement , a suspension of three months shall be applied .

jeigu trečiojo pažeidimo atveju trūkstamo užstato arba pinigų suma sudaro nuo 40 iki 80% visos teiktinos užstato arba pinigų sumos, taikomas dviejų mėnesio nušalinimas; ii)
( ii) if the amount of non-delivered collateral or cash is between 40% and 80% of the total collateral or cash to be delivered on the occasion of the third infringement, a suspension of two months shall be applied;

nušalinama toliau nurodytais atvejais: i) jeigu trečiojo pažeidimo atveju trūkstamo užstato arba pinigų suma sudaro iki 40% visos teiktinos užstato arba pinigų sumos, taikomas vieno mėnesio nušalinimas;
the suspension shall be applied in accordance with the following scale:( i) if the amount of non-delivered collateral or cash is up to 40% of the total collateral or cash to be delivered on the occasion of the third infringement, a suspension of one month shall be applied;
