14.8. in caso di comportamento inadempiente da parte del committente, con particolare riferimento alla morosità, successivamente al sollecito o a grave insolvenza imminente del committente, il fornitore è legittimato a ritirare la merce con riserva di proprietà e, dal canto suo, il committente è obbligato alla restituzione della medesima.

(5) if the reserved goods are processed by the customer, it is agreed that such processing is done in the name and on behalf of the supplier and that the supplier directly acquires title to the newly created goods or – if the processing includes materials from several manufacturers or the value of the newly created goods is greater than the value of the reserved goods – co-ownership (fractual ownership) of the newly created goods, in a ratio that is proportionate to the ratio between the value of the reserved goods and the value of the newly created goods.
