2. αν το εισαγωγικό έγγραφο της δίκης ή άλλο ισοδύναμο έγγραφο δεν έχει επιδοθεί στον ερημοδικήσαντα εναγόμενο κανονικά και έγκαιρα ώστε να μπορεί να αμυνθεί,
2. where it was given in default of appearance, if the defendant was not duly served with the document which instituted the proceedings or with an equivalent document in sufficient time to enable him to arrange for his defence

α) το πρωτότυπο ή κυρωμένο αντίγραφο του εγγράφου που αποδεικνύει ότι το εισαγωγικό έγγραφο της δίκης ή άλλο ισοδύναμο έγγραφο έχει επιδοθεί ή κοινοποιηθεί στον ερημοδικήσαντα διάδικο
(a) the original or certified true copy of the document which establishes that the defaulting party was served with the document instituting the proceedings or with an equivalent document;

i) το εισαγωγικό έγγραφο της δίκης ή άλλο ισοδύναμο έγγραφο έχει επιδοθεί ή κοινοποιηθεί στον ερημοδικήσαντα διάδικο κανονικά και έγκαιρα ώστε να μπορεί να αμυνθεί, ή,
(i) the person defaulting was served with the document which instituted the proceedings or with an equivalent document in sufficient time and in such a way as to enable that person to arrange for his or her defense,; or,

αν το εισαγωγικό έγγραφο της δίκης ή άλλο ισοδύναμο έγγραφο δεν έχει επιδοθεί ή κοινοποιηθεί στον ερημοδικήσαντα εναγόμενο εγκαίρως και κατά τέτοιο τρόπο ώστε να μπορεί να αμυνθεί, εκτός εάν ο εναγόμενος παρέλειψε να ασκήσει προσφυγή κατά της αποφάσεως ενώ μπορούσε να το πράξει
where it was given in default of appearance, if the defendant was not served with the document which instituted the proceedings or with an equivalent document in sufficient time and in such a way as to enable him to arrange for his defence, unless the defendant failed to commence proceedings to challenge the judgment when it was possible for him to do so;

αν το εισαγωγικό έγγραφο της δίκης ή άλλο ισοδύναμο έγγραφο δεν έχει επιδοθεί ή κοινοποιηθεί στον ερημοδικήσαντα διάδικο έγκαιρα και κατά τρόπον ώστε να μπορεί να αμυνθεί, εκτός εάν βεβαιωθεί ότι ο διάδικος έχει δεχτεί την απόφαση κατά τρόπο μη επιδεχόμενο αμφισβήτηση·
where it was given in default of appearance if the person in default was not served with the document which instituted the proceedings or with an equivalent document in sufficient time and in such a way as to enable that person to arrange for his or her defense unless it is determined that such person has accepted the judgment unequivocally;

Όταν πρέπει να διαβιβασθεί εισαγωγικό δίκης έγγραφο ή άλλη ισοδύναμη πράξη σε άλλο κράτος μέλος με σκοπό την επίδοση ή την κοινοποίηση σύμφωνα με τις διατάξεις του παρόντος κανονισμού, και έχει εκδοθεί απόφαση κατά ερημοδικήσαντος εναγομένου, ο δικαστής έχει την ευχέρεια να απαλλάξει τον εναγόμενο από τα αποτελέσματα της παρόδου της προθεσμίας για την άσκηση ενδίκου μέσου κατά της απόφασης, εφόσον πληρούνται οι ακόλουθες προϋποθέσεις:
when a writ of summons or an equivalent document has had to be transmitted to another member state for the purpose of service, under the provisions of this regulation, and a judgment has been entered against a defendant who has not appeared, the judge shall have the power to relieve the defendant from the effects of the expiration of the time for appeal from the judgment if the following conditions are fulfilled:
