indien de overheid definitief en onherroepelijk door een rechtbank of naar aanleiding van een uitspraak in een geschillenbeslechtingsprodecure aansprakelijk wordt gesteld voor en wordt verplicht tot het schadeloos stellen van gelaedeerden voor het verlies van of schade aan goederen ten gevolge van een ongeval op zee waarvan voor die rechtbank bewezen is dat het veroorzaakt is door een nalatige of roekeloze handeling dan wel verzuim van de erkende organisatie, haar organen, werknemers, vertegenwoordigers of anderen die namens de erkende organisatie optreden, heeft de overheid recht op schadeloosstelling door de erkende organisatie in de mate waarin het verlies of de schade naar het oordeel van die rechtbank door de erkende organisatie werd veroorzaakt; de lidstaten kunnen het door de erkende organisatie te betalen maximumbedrag beperken, maar een dergelijke limiet moet ten minste 2 miljoen eur bedragen;
if liability arising out of any marine casualty is finally and definitely imposed on the administration by a court of law or as part of the settlement of a dispute through arbitration procedures, together with a requirement to compensate the injured parties for loss of or damage to property, which is proved in that court of law to have been caused by any negligent or reckless act or omission of the recognised organisation, its employees, agents or others who act on behalf of the recognised organisation, the administration shall be entitled to financial compensation from the recognised organisation, to the extent that that loss or damage was, as decided by that court, caused by the recognised organisation; the member states may limit the maximum amount payable by the recognised organisation, which must, however, be at least equal to eur 2 million;
