article 113 refers to the right of an individual to bring an action for deprivation of liberty, as defined in the criminal code, against an official who keeps him in custody for over 24 hours without questioning him.

٦ - تعرض السكان المدنيين ﻷعمال تعسفية واعتقال وحجز الحريات وسوقهم للسجون والتحقيق معهم وتعرضهم ﻷشد أنواع التعذيب النفسي والجسدي وفي بعض اﻷحيان أدى التعذيب إلى مقتل اﻷسرى وإيصال البعض لمرحلة العاهات الدائمة.

120- وإذا أهمل هؤلاء العمل بما تقدم اعتبروا شركاء في جريمة حجز الحرية الشخصية وجرت الملاحقة بحقهم بهذه الصفة.

كما تضمن الفصل الثاني بالباب السادس من القانون مواد ذات علاقة بالبروتوكول الاختياري تعنى بتجريم حجز الحرية الشخصية، والمواد هي:
section 2, chapter vi, of the code contains provisions of relevance to the optional protocol which make it an offence to deprive a person of his liberty. the articles in question are:

228- وهكذا لا يمكن احتجاز شخص دون توجيه تهمة إليه، وإلا اعتبر ذلك حجز حرية غير مشروع يعاقب عليها القانون.
accordingly, no one can be detained without charge, as this would constitute a punishable act of unlawful restriction of liberty.

182- سجل تقدماً ملموساً بالنسبة للأطفال المخالفين للقانون والمعرضين للخطر، إذ نص القانون الجديد رقم 422 تاريخ 6 حزيران/يونيه 2002 على وجود عقوبات بديلة عن التوقيف وحجز حرية الطفل بإبقائه ضمن عائلته مع مراقبة اجتماعية، وقد بدأ تطبيق هذه العقوبات البديلة (المادة 18 و20 و26 و27 قانون حماية الأحداث).
182. a noticeable progress has been registered in the context of children in conflict with the law and at risk; where the new law no. 422 dated 6/6/2002 established alternative sanctions to detention and deprivation of freedom of the child through keeping him/her in his/her family environment with social supervision, and these new alternative sanctions are being implemented (article 18, 20, 26 and 27 of the law for protection of delinquents).
