وبعدئذ يقرر المفـوض القانوني الحكـم في جلسة مغلقة ثم يصوغ منطوق الحكم الذي يقرأ علناً في المحكمة.
subsequently, the law commissioner decides the sentence in camera and then formulates the purview of the sentence which is publicly read in court.

151 - وفي 13 تموز/يوليه 2009، أصدرت المحكمة حكمها وفيما يلي نص فقرة منطوق الحكم:
151. on 13 july 2009 the court rendered its judgment, of which the operative paragraph reads as follows:

ويجدر القول بأن هذا الاستنتاج كان ينبغي أن ينعكس في منطوق الحكم مشفوعا بالتأكيد بأن الأرض الفلسطينية المحتلة لا يمكن ضمها.
it is submitted that this finding should have been reflected in the dispositif with an affirmation that the occupied palestinian territory cannot be annexed.

إذا وجدت محكمة التمييز أن منطوق الحكم موافق من حيث نتيجته لأصوله الشرعية صدقته مع توجيه نظر القاضي إلى ما قد يكون لها من ملحوظات.
if the court of cassation finds that the substance of the judgement conforms in terms of its result to its shari’ah origins then it shall certify the same and shall direct the attention of the judge to whatever remarks it might have.

(ب) إذا وقع بطلان في الحكم أو بطلان في الإجراءات أثَّر في الحكم أو كان منطوق الحكم مناقضاً بعضه لبعض؛
(b) the judgement is vitiated or a procedure affecting the judgement was vitiated, or there are internal contradictions in the text of the judgement;

غير أن المحكمة لم تقيّم هذه الملابسات ولم تشر إليها في منطوق حكمها.
however, the court did not assess them nor present them in its judgement.

يجوز للمحكمة التي أصدرت الحكم بالإدانة أن تأمر بتأجيل تنفيذ الحكم الجزائي لأسباب جوهرية توضحها في أسباب حكمها ، على أن تحدد مدة التأجيل في منطوق الحكم.
the court rendering a judgment of conviction may order that the execution of its penal judgment be postponed if there are material reasons for such postponement. the judgment shall specify in its text these reasons as well as the period of postponement.

146- وفي 15 كانون الأول/ديسمبر 2004، أصدرت المحكمة حكمها في كل واحدة من هذه القضايا، وفيما يلي نص فقرة منطوق الحكم:
146. on 15 december 2004 the court delivered its judgment in each of these cases, the operative paragraph of which reads as follows:

73- وقَبِل الفريق العامل اقتراحا بقلب ترتيب الفقرتين 1 و2، بحيث يأتي التعريف الذي ينص على الحالات التي تعتبر البضاعة بحدوثها قد بقيت دون تسليم، قبل منطوق الحكم.
the working group accepted a proposal to reverse the order of paragraphs 1 and 2, so as to place the definition on when goods could be deemed to be undeliverable, before the operative provision.

وخلال الإجراءات القضائية، أشار محامي السيد ماتفييف إلى هذه الملابسات لكن المحكمة لم تقيّمها ولم تشر إليها في منطوق حكمها.
