the trustees in accordance with the express wishes of the primary beneficiaries hereby declare the trusts powers and provisions appearing below for the benefit of the beneficiaries mentioned below in respect of the advanced fund as herein defined to be held on and with and subject to the following trusts powers and provisions

7. taxes and charges. this lease is intended to be a net lease, and all payments net to lessor to the extent permitted by applicable law. lessee shall pay directly (or, at lessor’s option, reimburse lessor for) all license fees, assessments and other government charges, and all sales, personal property , use, excise, franchise, and any other similar taxes (collectively, “charges”) now or hereafter imposed, levied or assessed by any state, federal or local government or agency upon any of the equipment or upon the leasing, purchase, ownership, use, possession, financing or operation thereof, or upon the receipt of rental payments therefore, even if lessee’s status provides for its exemption from the charges (excluding income and gross receipt taxes on the rent payments, except any such tax which is a substitution for, or relieves lessee from, the payment of taxes which lessee would otherwise be obligated to pay or reimburse lessor as herein provided) before the same shall become in default or subject to the payment of any penalty or interest.
la presente locazione è intesa al netto dei costi e tutti i canoni di locazione dovranno essere corrisposti al locatore al netto dei costi nella misura consentita dalla legge applicabile. il conduttore pagherà direttamente (o, a scelta del locatore, rimborserà al locatore stesso) tutti i compensi per la concessione in licenza, le imposte ricorrenti e le altre imposte decretate dal governo, nonché tutte le imposte su vendite, proprietà personale, uso, fabbricazione, privativa e imposte analoghe (collettivamente le “spese”) già esistenti e future, stabilite o decretate da qualsiasi governo o agenzia locale, federale o statale su qualsiasi attrezzatura ovvero su locazione finanziaria, acquisto, proprietà, utilizzo, possesso, finanziamento o funzionamento dell'attrezzatura o sul ricevimento di canoni di locazione per l'attrezzatura, anche nell'ipotesi in cui lo stato del conduttore preveda l'esenzione dalle spese (escluse le imposte sul reddito e sulle entrate lorde relative ai canoni di locazione, fatta salva l'ipotesi in cui tali imposte siano in sostituzione o liberino il conduttore dal pagamento di imposte che sarebbe altrimenti obbligato a pagare o a rimborsare al locatore come qui stabilito) prima che lo stesso diventi inadempiente o soggetto al pagamento di sanzioni o interessi.
