1 - إذا وقع الإدعاء بالاستحقاق بعد هلاك المبيع بيد المشتري ضمن للمستحق قيمته يوم الشراء ورجع على البائع بالثمن.

فالمادة الأولى من الفصل (المادة 66) تبيّن الآثار بالنسبة للمشتري بعد انتقال تبعة هلاك البضاعة أو تلفها إليه.

1- توفر المادة 67 قواعد بشأن متى تنتقل تبعة الهلاك أو التلف إلى المشتري إذا تضمّن عقد البيع نقل البضاعة.

وذكرت المحكمة أن السبب في اسناد تبعة الهلاك إلى البائع مما هو ناجم عن إعادة البضائع المعطوبة بمقتضى المادة 82 من اتفاقية البيع هو سبب له ما يسوغه لأن تبعة مثل هذا التلف قد نشأت من جراء الاخفاق المؤكد من جانب البائع في تسليم بضائع متوافقة مع المواصفات.

وتبين المادة الأخيرة من الفصل (المادة 70) تحديد تبعة الهلاك أو التلف إذا ارتكب البائع مخالفة جوهرية.
the final article of the chapter (article 70) states the allocation of the risk of loss or damage if the seller commits a fundamental breach.

9- إذا لم يكن البائع ملزما بتسليم البضاعة إلى الناقل في مكان معيّن، تنتقل تبعة الهلاك أو التلف عندما تسلم البضاعة إلى أول ناقل.
9. if the seller is not bound to hand over the goods to a carrier at a particular place, the risk of loss or damage passes when the goods are handed over to the first carrier.
