nous recommandons : a. la création, aux termes de la loi sur les brevets, ou par le commissaire aux brevets si ses pouvoirs le lui permettent, d'un conseil d'examen des licences pour inventions brevetées (celib), dont le mandat serait de conseiller le commissaire sur des questions ayant trait à l'octroi de licences à l'égard d'inventions brevetées aux termes des articles 19 et 65 de la loi puisque le commissaire doit renvoyer au conseil, notamment : i. les conditions, critères ou règles aux termes desquels les licences devraient être accordées; ii. les lignes directrices visant à établir les modalités et conditions des licences, y compris l'indemnisation des brevetés; iii. si, dans des cas particuliers, les circonstances justifient l'octroi d'une licence; iv. les ajouts, suppressions, élaborations ou autres changements qu'il convient d'apporter aux conditions, critères ou règles aux termes desquels les licences peuvent être accordées en tenant compte des nouvelles tendances en matière d'innovation. b. que le celib dispose des pouvoirs suivants : i. tenir des audiences auxquelles les demandeurs de mesures correctives aux termes des articles 19 et 65 et les brevetés sont invités à comparaître et à présenter des observations; ii. prendre les mesures, dans un délai raisonnable, que le celib estime indiquées afin de favoriser un règlement négocié entre les demandeurs et les brevetés; iii. créer des comités d'enquête qui sont compétents dans des domaines précis, p. ex., dans les technologies de la santé.
we recommend that: a. a patented inventions licencing review board (pilrb) be established under the patent act, or by the commissioner of patents if his/her authority to do so already exists, to provide advice to the commissioner on such matters pertaining to the licensing of patented inventions under sections 19 and 65 of the act as the commissioner shall refer to the board, including, without limitation: i. the conditions/criteria/rules under which licences should be issued; ii. guidelines for establishing the terms and conditions of said licences, including compensation of patentees; iii. whether, in particular cases, the circumstances warrant the issuing of a licence; iv. desirable additions, deletions, elaborations or other changes to the conditions/criteria/rules under which licences may be issued taking into account emerging trends in innovation. b. the pilrb be empowered to: i. hold hearings in which the applicants seeking remedies under sections 19 and 65, and the patentees are invited to appear and to make representations; ii. take such steps, within reasonable time limits, as the pilrb deems appropriate to encourage a negotiated settlement between applicants and patentees; and, iii. establish hearing panels with expertise in particular fields; e.g. health technologies.
