perayu dalam kes ini adalah seorang janda si mati dan pentadbir harta pusaka. thedeceased tidak membuat wasiat bagi pihak hartanya. responden adalah seorang lagi janda(isteri kedua) mat dawi yang menuntut perayu untuk perisytiharan bahawa semua harta alih dan tak alih adalah ’harta syarikat’ dan dia juga berhak mendapat separuh dalam harta tersebut. semasa perbicaraan, mahkamah berpendapat bahawa responden berhak mendapat satu bahagian separuh dalam ‘harta syarikat’ menurut undang-undang mohammedan.
the appellant in this case was a widow of the deceased and administratix of the estate. thedeceased did not make a will on behalf of his property. the respondent was another widow(second wife) of mat dawi who sued the appellant for a declaration that all movable andimmovable property was ‘ harta syarikat’ and she is also entitled to a half in the property.during the trial, the court held that the respondent entitled to a one half share on the ‘harta syarikat’ according to mohammedan law.
