no seu acórdão de 25 de janeiro de 1994 (angelopharm gmbh contra freie und hansestadt hamburg), o tribunal de justiça das comunidades europeias invalidou o disposto no artigo 1.o da décima segunda directiva 90/121/cee da comissão(3), que adapta ao progresso técnico os anexos ii, iii, iv, v e vi da supramencionada directiva 76/768/cee, na parte em que acrescenta a substância 11 alfa ohp (>iso_7>á->iso_1>hidroxi-11 pregneno-4-diona-3,20) e os seus ésteres à lista das substâncias que não podem entrar na composição dos produtos cosméticos, constante do supramencionado anexo ii, com base em que a inscrição desta substância na referida lista do anexo ii deveria ter sido motivada por um parecer do comité científico dos produtos cosméticos e dos produtos não alimentares, o que não se verificara.
in its judgment of 25 january 1994 (angelopharm gmbh v freie hansestadt hamburg) the court of justice of the european communities invalidated the provisions of article 1 of twelfth commission directive 90/121/eec(3) adapting to technical progress annexes ii, iii, iv, v and vi to directive 76/768/eec referred to above, with a view to including the 11>iso_7>á->iso_1>hydroxypregn-4-ene-3, 20-dione) and its esters on the list of substances that are prohibited in cosmetic products pursuant to the abovementioned annex ii. as grounds for its judgment, the court ruled that the listing of this substance in the abovementioned annex ii should have been justified by a report from the scientific committee on cosmetic products and non-food products but that no such justification had been provided.
