výraz „aniž jsou dotčeny ostatní předpisy společenství“ v čl. 15 odst. 1 směrnice 2003/96/es nelze vykládat v tom smyslu, že umožňuje použít články 87 a 88 smlouvy na jakékoli opatření na snížení nebo osvobození od spotřební daně, neboť pokud by zákonodárce společenství chtěl přezkoumat veškerá opatření na úpravu spotřební daně se zřetelem na články 87 a 88 smlouvy, byl by tento záměr vyjádřil vložením odkazu na tyto články podle základní zásady výkladu zákona lex ubi voluit dixit; naproti tomu v kterémkoli aktu společenství je záměr zákonodárce, který chce podrobit daná opatření pravidlům z oblasti státní podpory, vyjádřen jasně, nikoli prostřednictvím obecné formulace typu „aniž jsou dotčeny ostatní předpisy společenství“, a kromě toho je tím spíše nutná jasná a jednoznačná formulace, aby kvalifikace opatření jako „znamenající státní podporu“ nebo „neznamenající státní podporu“ měla významný dopad na povahu, způsob a dobu trvání výkonu samotného opatření;
