ويرى الفريق العامل أن "الاحتجاز الإداري " بموجب تشريع خاص بالأمن العام حيثما طُبّق بهدف احتجاز أشخاص يشتبه في ضلوعهم في أنشطة إرهابية أو جرائم أخرى للتحايل على الضمانات القضائية، إنما يتعارض أيضاً مع أحكام المادة 14 من العهد الدولي الخاص بالحقوق المدنية والسياسية الذي صدّقت عليه الجزائر.
