sud ima ovlasti da odluči o tome smije li podnositelj ostati na području nadležne države članice ili ne, djelujući na podnositeljev zahtjev ili po službenoj dužnosti, a podnositeljevo pravo na ostanak u toj državi članici ukida se kao posljedica bilo koje od sljedećih kategorija odluka:
a court or tribunal shall have the power to rule whether or not the applicant may remain on the territory of the member state responsible, either upon the applicant’s request or acting ex officio, where the applicant's right to remain in the member state is terminated as a consequence of any of the following categories of decisions:

(c) podnositeljev je povratak u njegovu zemlju podrijetla ili boravišta ili tranzit preko država koje nisu države članice, a koje u cijelosti primjenjuju schengensku pravnu stečevinu, ocijenjen sigurnim.
(c) the applicant’s return to his country of origin or residence or transit through states other than member states fully implementing the schengen acquis is assessed as certain.
