İş sahibi; yüklenici’ye yazılı olarak ihtarda bulunacak ve şayet yüklenici bu ihtarı müteakip söz konusu ihlali 5 (beş) takvim günü içerisinde düzeltmez yahut ihlale devam eder ise 5 (beş) günün sonunda, yahut şayet söz konusu ihlal herhangi bir süre verilmesinin faydasız kalacağının anlaşılabileceği bir ihlal ise derhal sözleşme’yi her türlü tazminat hakkı saklı kalmak kaydı ile derhal feshetme hakkına sahiptir.
the owner shall serve a written notification to the contractor and if the contractor fails to remedy this breach within 5 (five) calendar days following this notification or continues to breach it, the owner shall be entitled to terminate the contract at the end of 5 (five) days or if the said breach is a breach understood that granting such extension of time is of no avail, the owner shall be entitled to terminate the contract with immediate effect without prejudice to all kinds of compensation rights.
