25 il s’ensuit que, en principe, une limitation, au sens de l’article 44, paragraphe 1, du règlement n° 40/94, de la liste des produits ou des services contenus dans une demande de marque communautaire, qui intervient postérieurement à l’adoption de la décision de la chambre de recours attaquée devant le tribunal, ne peut affecter la légalité de ladite décision, qui est la seule contestée devant le tribunal [voir, en ce sens, ordonnance budweiser, point 23 supra, points 40 à 48, et arrêt du tribunal du 20 novembre 2007, tegometall international/ohmi – wuppermann (tek), t‑458/05, non encore publié au recueil, point 23].
25 it follows that, in principle, a restriction within the meaning of article 44(1) of regulation no 40/94 to the list of goods or services contained in a community trade mark application made after the adoption of the decision of the board of appeal challenged before the court cannot affect the legality of that decision, which is the only decision being challenged before the court (see, to that effect, the order in budweiser, cited in paragraph 23 above, paragraphs 40 to 48, and case t‑458/05 tegometall international v ohim – wuppermann (tek) [2007] ecr ii‑0000, paragraph 23).
